<br />4. <br /> <br />That all costs of construction and incidentaJ costs and liabilities incurred in <br />the construction of said jointly owned bridge, with the expectation of the <br />approaches to the bridge constructed within each County, shall be shared <br />equally on a 50-50 basis between Clay County and CaBS County. <br /> <br />5. <br /> <br />That all costs of construction and incidental costs and liabilities incurred in <br />the construction of the approaches to the bridge constructed within each <br />County shall be the responsibility of each County individually. <br /> <br />6. <br /> <br />That should any refunds or damages become due ITom the contractor <br />aw,u-ded the construction contract, its bonding agent or any other person <br />or entity, said refunds or damages shall be shared equally on a 50-50 basis <br />between Clay and Cass County. <br /> <br />7. <br /> <br />That each County shall keep and maintain accurate and complete records of <br />any and all expenditures made by it on the construction of said jointly owned <br />bridge and that said records shall be opened to inspection by the other <br />County at reasonable times and hours. <br /> <br />8. <br /> <br />That within thirty (30) days after receipt of a bill or statement in connection <br />with said jointly owned bridge or upon determination by either party that any <br />amount is currently due and payable, the County receiving said bill or <br />statement or determining that any amount is currently due and payable shall <br />furnish a copy of said bill or statement to the other County. <br /> <br />9. <br /> <br />That within thirty (30) days after receipt of any document referred to in <br />Paragraph 8, the County receiving said document shaJl forward to and <br />reimburse the other County for its one half(Yz) share of the bill or <br />statement's total amount. <br /> <br />---- <br />
