Commission Minutes-February 17, 2009 3474

8. STATE'S ATTORNEY, Budaet adiustment for copier
State's Attorney Birch Burdick discussed a budget adjustment request for an office copier,
which was purchased in January. He said $30,000 was carried over from his 2008 budget
to cover costs to remodel the third floor. During 2009 budget hearings he discussed the
purchase of an additional copier. He also included a comment regarding the need for
another machine, but neglected to include the funds in his 2009 budget.

Mrs. Sorum asked if funds from the Drug Restitution budget may be used to cover the
expense. Mr. Burdick believes the fund may be used to pay for the copier. In the past,
monies from the Drug Restitution Fund have been used to print educational pamphlets
about the drug-fighting efforts of the county.

Mr. Burdick said the new copier also has printing and scanning abilities and is located on
the 4th floor. One of their other copiers was moved to the third floor for seven staff located in
the newly remodeled space.

Mr. Wagner asked the county auditor about percentage of reserves for the State's Attorney
budget. County Auditor Michael Montplaisir said the State's Attorney does not have a
separate reserve; if reserves were used to pay for the copier, the money would come from
the General Fund, which has about a 10% reserve.
MOTION, passed
Mr. Wagner moved and Mr. Bennett seconded to amend the State's
Attorney budget in the amount of $12,825 for the purchase of a copier,
using monies from the Drug Restitution Fund to cover the expense.
Discussion: There was discussion about the type of copier purchased
and the involvement of the Information Technology (IT) Department.
Terry Schmaltz, IT Director, said he may help to arrange demonstrations
on different machines, but the final decision is left to the department
head. Mr. Burdick said this incident was unique because of the
remodeling project expenses and does not anticipate this kind of
situation occurring again. On roll call vote, the motion carried
unanimously.

9. VOUCHERS, Approved
MOTION, passed
Mr. Vanyo moved and Mr. Wagner seconded to approve Voucher No.
233,507 through Voucher No. 233,868. On roll call vote, the motion
carried unanimously.

10. LEGISLATIVE SESSION; BUILDINGS AND GROUNDS UPDATE; JOINT PUBLIC
SAFETY BUILDING; JAIL ROOF DAMAGE SETTLEMENT; BUILDING COMMITTEE;
NDACo COUNTY OFFICIALS ACADEMY, Committee reports
County Administrator Bonnie Johnson said she monitors the legislative session daily to keep
track of issues which may affect Cass County. The legislature will be on crossover break
February 20th through February 24th, so the legislative meeting will not be held this Friday.

Mrs. Johnson said an air conditioner upgrade was done in the Information Technology
Office last week to help with cooling issues in the server room.
