The funds cannot be used to build or maintain <br />roads and bridges, but may be used to enhance transportation systems, i.e. landscape <br />projects, bike paths or multi-use paths. <br /> <br />Mr. Berndt submitted a list which includes two different kinds of projects. The 90-day <br />projects are for tree plantings and the 180-day projects include multi-use paths. He said <br />actual applications for TE funds need to be completed by February 3, 2009. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Bennett seconded to approve the list of <br />possible Transportation Enhancement Fund Stimulus projects and <br />authorize the county engineer to submit the list to the North Dakota <br />Department of Transportation. Discussion: Mr. Pawluk asked about the <br />status of the other construction projects submitted for the overall <br />stimulus package. Mr. Berndt said the county submitted two projects for <br />consideration. He said the expectation is that North Dakota may receive <br />between $80 and $200 million. These funds would be dispersed similar <br />to the distribution formula used for other federal funds received with 75% <br />allotted to the state, 8% to counties and 17% to cities. On roll call vote, <br />the motion carried unanimously. <br /> <br />8. PUBLIC COMMENT, David Habiaer <br />David Habiger, resident of rural Amenia, was present. He discussed his concerns with the <br />State Department of Health inspection of his property in rural Amenia last June and removal <br />of cars from his property in the City of Casselton last month. He again asked for the <br />charges against him from the incident in June to be dropped by county prosecutors. <br /> <br />9. PERSONNEL SUBCOMMITTEE, Members appointed for benefit review <br />Mr. Wagner said at the last Personnel Overview Committee meeting held two weeks ago, <br />the chairwoman was authorized to appoint members to serve on a subcommittee to conduct <br />a benefits review for domestic partnerships. He believes following protocol is important and <br />a subcommittee is normally part of the body of the whole committee. One of the suggested <br />appointments, Gail Wischmann, is not a member of the Personnel Overview Committee. <br />Mr. Pawluk also thought the subcommittee members were to be chosen from the entire <br />Personnel Overview Committee. <br /> <br />Mrs. Sorum said Ms. Wischmann asked to serve on the subcommittee and has done a lot of <br />research on the topic. The subcommittee will be studying the issue and will then forward <br />their findings to the entire Personnel Overview Committee for consideration. <br /> <br />Mr. Wagner said objectivity may also be an issue and again stated that usually a <br />subcommittee is part of the body of the whole committee. Mrs. Sorum withdrew Ms. <br />Wisch mann's name from the subcommittee appointments. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Pawluk seconded ratify the action of the <br />Personnel Overview Committee meeting held January 5, 2009, and <br />appoint the following to serve on a personnel subcommittee for benefits <br />review: Robyn Sorum, Bonnie Johnson, Mike Montplaisir, Birch Burdick, <br />Chip Ammerman, and Linda Skogen. On roll call vote, the motion carried <br />with four members voting "Yes" and Mrs. Sorum voting "No". <br />
