b) Acquisition of Additional Features. Should any party to this Agreement wish to acquire additional features to the software and equipment acquired by Fargo and made available for use by the RRRDC hereunder, only parties requesting those features will be responsible for the acquisition, maintenance and operational costs of said additional features. c) Local Match. The total grant amount of $3,000,000.00 (Three Million Dollars and 00/100) includes a local match of $750,000.00 (Seven Hundred Fifty Thousand Dollars and 00/100). This amount shall be contributed equally by all five (5) of the voting agencies that are parties hereto. Fargo, Moorhead, Cass County, Clay County, and West Fargo shall each contribute $150,000.00 (One Hundred Fifty Thousand and 00/100 Dollars). The City of Fargo will bill each of the agencies for their share of the local match over a three (3) year period with each annual equal installment of $50,000.00 being due on or before January 31, 2009 , January 31, 2010, and January 31, 2011. d) Authorized Use. Access to the CAD/RMS System will be granted to the aforementioned agencies and the agencies listed as authorized users in the software license agreement. e) Additional Authorized Users. Additional parties may be granted access to the CAD/RMS system upon approval by the RRRDC Board of Authority. t) Data Practices. Each agency understands and agrees that they will continue to be the responsible authority for data created by their agency. Each agency shall be responsible for controlling access to the CAD/RMS by its employees so that the information and data maintained by the CAD/RMS is used for legitimate law enforcement and public safety purposes. Each agency shall remain liable for any misuse by their own employees or agents of the first party information maintained in the CAD/RMS. Nothing in this Agreement shall be construed as changing the responsibilities for data management, data practices requests, access procedures, and compliance responsibilities for the individual agencies. Each agency agrees that the originator of the data continues to own the data and will retain all responsibilities attendant to the creation, disposition and maintenance of such data. All requests for the release of or access to such data will be forwarded to the originating agency. g) Funding Formula for the Software Maintenance Agreement and ongoing licensing fees. The following formula will be used only for the annual software maintenance fees and ongoing licensing fees. The costs associated with the Software Maintenance Agreement and ongoing license fees will be pro-rated between Fargo, West Fargo, Moorhead, Cass County and Clay County based on the total number of work stations and mobile data computers using the CAD/RMS software. Each agency will provide an inventory of work stations and mobile data computers to the RRRDC Director annually on or before July 1. Computers used by agencies other than those specified in this section will be assigned as follows: . Computers used by NDSU Campus Police will be considered Fargo computers.
