<br />D. Clay County - 11 % <br />E. West Fargo - 8.9% <br /> <br />These percentages are based, in part, on the current Metro-COG formula and on the desire to <br />provide joint dispatch services on behalf of other non-member agencies. All payments required <br />by the terms of this agreement shall be made on at least a quarterly basis. This formula applies, <br />except as specifically provided in section nine (9) hereof. <br /> <br />7. Amendment. The parties recognize and agree that the future financial obligations may <br />be adjusted as a result of census data or other factors. In that regard, the parties agree that the <br />financial contributions stated herein may be amended, as agreed upon by all of the parties, <br />without amending or altering the remaining terms and conditions of this joint powers agreement. <br /> <br />8. Real and Personal Property. The personal property used in the joint undertaking may <br />be acquired, held or disposed of in the name of the joint board unless otherwise agreed upon. <br />The real property, if any, used in the joint undertaking may be acquired, held or disposed of in <br />the name of any of the contracting governmental entities upon agreement that title shall be thus <br />held. <br /> <br />9. Acquisition and Maintenance of Computer Aided Dispatch and Records <br />Manae:ement System. The parties agree that the funds from the Grant will be used to purchase <br />the CAD/RMS software, system hardware, network equipment and related components needed <br />during system implementation and all such equipment and software will be the property of Fargo <br />for the life of the Grant. Fargo will make available to the RRRDC, through a separate Software <br />Use Agreement, (see Exhibit "A"), all said hardware, software and equipment during the term of <br />the Grant. RRRDC shall have the right to the use of said hardware, software and equipment <br />consistent with the terms hereof and the terms of the Grant agreement during the term of the <br />Grant. At the end of the grant period, following the submission of the Final Program Progress <br />(Closeout) Report, Fargo will transfer all ownership rights to said hardware, software and <br />equipment for the sum of $1.00 to the RRRDC. Fargo, as the grant recipient, will act as the <br />fiscal agent under the grant and has the authority to enter into both hardware and software <br />purchase, licensing and maintenance contracts as approved by the BOA. <br /> <br />a) Agencies Responsibility for Agency specific equipment. Each agency will be <br />responsible for the costs of acquiring, installing, and maintaining hardware necessary for <br />the use of the CAD/RMS application by that member, as recommended by the vendor, <br />excluding the hardware specified in the vendor's contract and installed during system <br />deployment. The equipment each agency is individually responsible for shall include, but <br />not be limited to, workstation computers, laptop computers, and appurtenances necessary <br />for the transmission of data from servers to laptop computers in member vehicles as well <br />as mounting hardware and installation. <br />
