<br />SUBJECT POLICY # Page of <br />MOTOR ~/EHICLE PURSUIT 1.09 2of7 <br /> <br />J <br /> <br />1. The occupant of a fleeing vehicle has committed a violent offense, or <br />threatened to use violence during the commission of an offense; or <br /> <br />2. A person attempts to escape or otherwise elude law enforcement through <br />the use of deadly force; or <br /> <br />3. A person indicates they will endanger human life or inflict great bodily <br />harm on another unless they are taken into custody without delay. <br /> <br />C. Deputy's will not initiate or otherwise engage in a motor vehicle pursuit in any <br />vehicle other than a marked police vehicle. A marked police vehicle is a <br />vehicle that is clearly recognizable as a police vehicle equipped with both <br />emergency lights and siren. <br /> <br />D. Deputy's will not initiate or otherwise engage in a motor vehicle pursuit for <br />any traffic offense which is outside the scope of the restrictions listed above. <br /> <br />E. <br /> <br />Deputy's will consider the following when deciding to initiate or otherwise <br />engage in a motor vehicle pursuit: <br /> <br />-J <br /> <br />1. The nature and seriousness of the offense. <br />2. The age and driving experience of the driver, if known, of the fleeing <br />motor vehicle; i.e. adult or juvenile. <br />3. The existing road, weather, and environmental conditions; i.e. time of day, <br />nearby schools and playgrounds, residential vs. business/industrial area, <br />etc. <br />4. The performance capabilities of both the police vehicle and the fleeing <br />vehicle. <br />5. The speeds of the vehicles involved. <br />6. The pursing deputy's familiarity with the area. <br />7. The presence of other persons in the police vehicle (civilian passengers). <br /> <br />F. It will be the responsibility of every deputy who initiates or otherwise engages <br />in a motor vehicle pursuit to operate their vehicle with due regard for the <br />safety of the general public, other law enforcement deputy's (including <br />themselves), and the occupant(s) of the fleeing vehicle. Every deputy will be <br />held accountable for their decision to initiate a motor vehicle pursuit and for <br />continuing their involvement in a pursuit. <br /> <br />..J <br />
