POLICY: <br /> <br />To establish a standard policy that provides the guidance necessary to regulate the <br />actions of the Cass County Deputies regarding motor vehicle pursuits. <br /> <br />II. PVRPOSE: <br /> <br />Cass County Deputies will only initiate or otherwise engage in a motor vehicle pursuit <br />in accordance with the parameters outlined below. Furthermore, it will be the policy <br />of the Cass County Sheriff s Office to recognize that the safety of the general public <br />and law enforcement deputy's involved is of paramount importance and will be the <br />primary consideration when deciding to initiate or otherwise engage in a motor <br />vehicle pursuit. <br /> <br />III. DEFINITIONS: <br /> <br />\." <br /> <br />A. <br /> <br />Motor Vehicle Pursuit: An attempt by a deputy, in a vehicle clearly marked <br />equipped with both emergency lights and siren, to apprehend the occupant of a <br />moving motor vehicle who is attempting to avoid apprehension through <br />evasive tactic/maneuvers. <br /> <br />B. Evasive Tactics/Maneuvers: Any driving action whereby the driver of a <br />motor vehicle demonstrates an attempt to either evade or flee from a deputy. <br />This may include, but is not limited to, an increase in speed, turning <br />movements, driving off of the roadway, and the disobedience of traffic control <br />devices. <br /> <br />C. Shift Supervisor: Patrol Sergeant, other senior ranking deputy of the Cass <br />County Sheriffs Office. <br /> <br />IV. INITIATION OF A MOTOR VEHICLE PURSUIT: <br /> <br />A. The decision to initiate a motor vehicle pursuit will be based on the initiating <br />deputy's conclusion that the immediate danger to the public created by the <br />pursuit is less then the immediate or potential danger to the public should the <br />person fleeing from the deputy remain at large. <br /> <br />~. <br /> <br />B. <br /> <br />A motor vehicle pursuit may be initiated only when: <br />
