<br />CASS COUNTY <br />PERSONNEL POLICY MANUAL <br /> <br />2.80 <br /> <br />SUBJECT: WEAPON POLICY <br /> <br />EFFECTIVE DATE: June 16, 2008 <br /> <br />PAGE 1 OF 1 <br /> <br />PURPOSE <br />The purpose of the Cass County Weapon Policy is to ensure the safety and <br />security of county employees and the general public in all county <br />facilities. This policy is in addition to N.D.C.C. 62.1-02-09 which <br />states, "A person, except for a law enforcement officer while on official <br />business, is guilty of a class C felony if the person possesses an <br />explosive or destructive device in a government building without the <br />written consent of the government agency or person responsible for the <br />management of the building." <br /> <br />For the purpose of this section, a weapon is defined as any gun, loaded <br />or unloaded; stun gun; BB gun; C02 gun; air gun; machete; sword; knives <br />with a blade of five (5) inches or more; bow & arrow; spear; any martial <br />arts weapon; or any other device intended to cause bodily harm to another <br />person, but is not included in this list. <br /> <br />POLICY <br />Any employee carrying a weapon shall be a peace officer licensed by the <br />State of North Dakota who has met all of the requirements for continuing <br />education as mandated by the peace officers board. <br /> <br />All employees must also be "qualified" with the weapon that is carried on <br />duty and must "qualify" with the same ammunition that is carried for <br />duty. The Cass County qualification procedures are to be the same <br />standards that are established by the State of North Dakota. The County <br />Sheriff, or his designee, is hereby assigned by the County Board of <br />Commissioners as the qualifications administrator. <br /> <br />Each department head must give approval to any employee who carries a <br />weapon on duty and must provide the name of the employee and the type of <br />weapon to the County Sheriff. The department head should consider the <br />position and duties of the employee when deciding whether a firearm is <br />appropriate. <br />
