<br />unconstitutional by the decision of any court of competent jurisdiction, <br />such decision shall not affect the validity of the remaining portions of <br />these regulations. <br /> <br />SECTION VIII- REGULATION ENFORCEMENT <br /> <br />Malfunctioning private on-site sewage disposal systems (including <br />septic tanks, cesspools, cisterns, dry wells, absorption bed-fields, <br />holding tanks, and the like) are a menace to the health and general <br />welfare of the citizens of this county and are hereby declared to be a <br />nuisance. <br /> <br />Whenever brought to the attention of the Health Officer that any <br />unsanitary conditions exist in any private sewage disposal system or <br />that any construction or work regulated by these regulations is <br />dangerous, unsafe, unsanitary, a nuisance or a menace to life, health <br />or property, or otherwise in violation of these rules and regulations, it <br />is the responsibility of the Health Officer to investigate the problem <br />and he/she may order any person using or maintaining any such <br />condition to repair, alter, change, remove or demolish the problem <br />area for the proper protection of life, health or property. <br /> <br />Every such order shall be in writing, addressed to the person using or <br />maintaining any such conditions and shall specify a reasonable date <br />or time for compliance with such order. <br /> <br />SECTION IX - GENERAL PROVISIONS <br /> <br />- No on-site disposal system shall be installed during wet conditions <br />or conditions by which the soil would become smeared during <br />construction. <br /> <br />- All sewage shall be disposed of by a valid method of collection, <br />treatment, and disposal. Sewage shall not be disposed of in any <br />manner that will create a nuisance. It shall not be discharged into <br />any abandoned or unused well, or into any crevice, sink hole, or <br />other opening either natural or artificial in a rock formation. Sewage <br />shall not be discharged into any river, stream, lake, pond or similar <br />water course. <br /> <br />10 <br />
