10. <br /> <br />11. <br /> <br />Commission Minutes--February 17, 2004 2701 <br /> <br />STATE'S ATTORNEY, Budget adjustment to asset forfeiture fund MOTION, passed <br /> Mr. Vanyo moved and Mr. Wagner seconded to amend the 2004 State's <br /> Attorney Asset Forfeiture Fund to include a line item for the purchase of <br /> supplies and equipment in the amount of $8,000.00. On roll call vote, the <br /> motion carried unanimously. <br /> <br />CONTRACT APPROVAL, Roadway Services, Inc. MOTION, passed <br /> Mr. Vanyo moved and Mr. Wagner seconded to approve the following <br /> contract submitted by respective department head, subject to state's <br /> attorney approval, and authorize the chair to sign: Roadway Services, <br /> Inc. for Cass County project CH 0413, to crack clean and seal various <br /> Cass County highways in the amount of $52,250.48. On roll call vote, <br /> the motion carried unanimously. <br /> <br />ORDINANCE #2004-1, First reading for vector/weed buildin_~ Dro|ect <br />Michael Montplaisir, County Auditor, reported that the recently appointed vector/weed <br />building committee held their first meeting on February 2, 2004. The committee reviewed a <br />draft ordinance, which is scheduled for first reading at this time. The purpose of the <br />ordinance is to facilitate the construction and financing of a building to house the functions <br />of the weed and vector control activities in Cass County. Mr. Montplaisir said the ordinance <br />consists of a history of the two programs, funding authority, building committee <br />responsibilities and a timeline for the project. The vector/weed building committee is <br />directed to substantially complete the project during the calendar year 2004. <br /> <br />The proposed ordinance has been reviewed by the State's Attorney, Birch Burdick. He <br />consulted with the North Dakota Attorney General's Office, who suggested adding language <br />indicating it is also the purpose of the ordinance to use a process and manner that is <br />different from and supercedes that provided in North Dakota Century Code 11-11-16 and <br />11-16-18. <br /> <br />The commission discussed financing, and Mr. Montplaisir said Cass County would borrow <br />the funds for this project, with payments being made through the weed and vector budgets. <br />Some county funding may also be needed, he said. MOTION, passed <br /> Mr. Wagner moved and Mr. Meyer seconded to approve the first reading <br /> of an ordinance for the construction and financing of a vector/weed <br /> building; and to set the second reading/adoption for March 15, 2004, to <br /> allow time for publishing a summary of the ordinance in the official <br /> newspaper at least 20 days between the first and second reading. On roll <br /> call vote, the motion carried unanimously. <br /> <br />VOUCHERS, Armroved MOTION, passed <br /> Mr. Bennett moved and Mr. Vanyo seconded to approve Voucher No. <br /> 184,702 through No. 185,125. On roll call vote, the motion carried <br /> unanimously. <br /> <br /> <br />
