<br />Commission Minutes-January 22,2008 3314 <br /> <br />project concept report and hydraulic report will be prepared and he believes the project will <br />have to include installation of larger openings for water drainage. <br />MOTION, passed <br />Mr. Wagner moved and Mrs. Sorum seconded to authorize the chairman <br />to sign a letter of comment to the North Dakota Department of <br />Transportation representative Houston Engineering, Inc. requesting they <br />include a Harwood bicycle and pedestrian improvement plan to Project <br />No. IM-S-029(OS9)069, PCN 16361 and IM-S-029(097)069, PCN 16767. On <br />roll call vote, the motion carried unanimously. <br /> <br />9. RESOLUTION #200S-3, Resolution of support for extraterritorial zonina authority <br />Mr. Berndt said the 2007 legislature temporarily reduced the distance cities may extend their <br />extraterritorial zoning and subdivision authority and directed a study be completed and a <br />report be provided during the 2009 legislative session. A meeting of the Advisory <br />Commission on Intergovernmental Relations will be held January 23, 2008, to hear <br />testimony and discuss this issue. He is requesting the commission consider a resolution of <br />support and allow him to testify at the meeting. He believes in order to allow cities to plan <br />for future growth and to minimize unnecessary tax burdens placed on citizens, the <br />extraterritorial zoning authority for cities over 25,000 be extended from 2 miles to 4 miles <br />and for cities over 5,000 from 1 mile to 2 miles. He said townships lack resources to <br />adequately plan for urban growth; a large portion of township board members are <br />volunteers and are not in the business to build infrastructure. He said while townships have <br />good intentions in regard to future planning, cities are in a better position to plan for growth. <br />If the zoning authority is not extended, a potential result may be premature annexation of <br />rural areas. <br /> <br />In response to a question from Mr. Wagner, Mr. Berndt said the extraterritorial zoning <br />figures used in the resolution of support are a result of prior committee work done on this <br /> <br />issue. <br /> <br />MOTION, passed <br />Mr. Wagner moved and Mr. Vanyo seconded to adopt Resolution #200S-3 <br />to support 4 mile extraterritorial zoning authority for cities over 25,000 in <br />population and 2 mile extraterritorial zoning authority for cities over <br />5,000 in population; and authorize the County Engineer to testify on <br />behalf of county government on this matter. Discussion: Mr. Wagner <br />agrees the county take the opportunity to testify and voice the county's <br />perspective on this issue. Mr. Vanyo supports good planning practices <br />and asked about the City of West Fargo's position. Mr. Berndt believes <br />West Fargo supports the additional zoning authority.
