My <br />brother and I own Currier Company who owns the property located at 3980 Highway 81 <br />North in Fargo (herein "Currier Property") which is directly adjacent to the Right-of- <br />Way. Currier Company desires to purchase the Right-of-Way and the Cass County <br />Auditor informed me to direct any inquiries about an offer to purchase to your attention. <br />The purpose of this letter is that Currier Company purposes to purchase Right-of-Way <br />from Cass County for the amount of eight hundred dollars ($800.00). <br /> <br />The Cass County Auditor supplied me with the Right-of- Way plat created in 1936 <br />by the State Highway Department and a deed recorded in 1936 conveying the Right-of- <br />Way property to the County. I obtained a survey of the Currier Property, including the <br />abutting Right-of-Way in July 1998, a copy which is enclosed for your reference. The <br />Auditor noted that the 1936 deed to the County legally describes the Right-of-Way as <br />being 117 feet in width, and not 120 feet as shown on our 1998 survey. We acknowledge <br />the difference in width and propose to use the legal description of the Right-of- Way from <br />the 1936 Right-of-Way plat and conveyance deed for consistency of the County records. <br /> <br />My understanding that in March 1999, the County sold approximately three acres <br />of a County right-of-way along Highway 81 in the Southeast Quarter of Section 15 in <br />Reed Township to an abutting property owner. The minutes from the Commission <br />Meeting indicate that the approval of the sale was largely due to the facts that the <br />property was no longer used as a highway right-of-way and that the property had no <br />value to anyone other than the abutting landowner. The County received $296.00 in <br />exchange for the sale of the right-of-way property. <br /> <br />The Right-of- Way that Currier Company proposes to acquire is similar to the <br />amount of land as in the March 1999 right-of-way transaction. <br /> <br />- <br /> <br />Equal Opportunity Employer <br />
