CITY OF CASSELTON AND CASS COUNTY GOVERNMENT HIGHWAY CONSTRUCTION AND MAINTENANCE AGREEMENT This contract is between Cass County Government and the City of Casselton. BACKGROUND: This City of Casselton desires to secure Federal Funds to assist with the construction of a new road to serve a grain terminal expansion project. The North Dakota Department of Transportation is agreeable to providing some Federal Funding for the project above and beyond Cass County's normal annual allotment of Federal Aid Funds. One condition of eligibility for Federal Funds is that the road be part of the Cass County Highway system. The proposed road is not consistent with Cass County's typical criteria for County Highways. Cass County wishes to assist the City of Casseiton in securing funding for the project, but wishes to cap the County Funds spent toward the project at $20,000. Cass County is agreeable to placing the proposed road on the County Highway system for a period of up to 10 years contingent upon the City's agreement to assume all initial and future costs and liabilities associated with the proposed road and to accept future ownership of the road. PURPOSE OF CONTRACT: The purpose of this contract is to outline the conditions under which a new proposed road will be added to the Cass County Highway System. Cass County Obligations: 1. To take appropriate steps with the North Dakota Department of Transportation to formally add the proposed road to the County Highway system for the purpose of obtaining special Federal Aid Funding. 2. To contribute up to $20,000 for the project. The funds would be used for initial planning and engineering activities. All other project related expense incurred by the County will be reimbursed by the City of Casselton. 3. To act as project sponsor for the purpose of obtaining Federal Aid Funding. As such, the County will contract with for the project Engineering and Construction. 4. During the construction of the project, the County will: ao Provide engineering services, material testing, inspection of the work, and administer the construction contract as required by the contract documents and the current edition of NDDOT's Standard Specifications for Road and Bridge Construction, Sampling and Testing Manual, and Construction Manual. b. Keep ali project records and documentation as required in NDDOT's current edition of the FieM Office Procedures Manual and the Construction Automated Record System. Co Make all records available to City, NDDOT, and FHWA for inspection upon request. Submit all documents and records to NDDOT for review before final payment is made. NDDOT will maintain the project records for three years from the final voucher date of FHWA and then return them to the County.
