NOTE: <br /> <br /> a. <br /> <br />bo <br /> <br />do <br /> <br />do <br /> <br />Be responsible for any changes in plan, character of work, quantities, site conditions, or <br />any claim for extra compensation. NDDOT will review all contract adjustments to <br />determine if the adjustments are eligible for federal aid. <br /> <br />On behalf of the County, NDDOT will: <br /> <br />Prepare the bid proposals, print and distribute the proposals and plans, solicit proposals and <br />include the project in a scheduled bid opening, as provided in NDCC Chapter 24-02. <br /> <br />Evaluate the bids as to the sufficiency of Small Business participation and the bidders good <br />faith efforts in satisfying the requirements of the current edition of special provision, Small <br />Business Participation and 49 CFR Part 26, Participation by Disadvantage Business <br />Enterprises in DOT programs. NDDOT shall have exclusive authority in evaluating the <br />adequacy of Small Business participation. <br /> <br />Tabulate the bids and send to the County for its determination of the lowest responsible <br />bidder and the execution of the contract. <br /> <br />Concur in the award of the contract for the sole purpose of enabling the County to procure <br />federal aid for the construction of the project. <br /> <br />e. Distribute copies of the executed contract, plans and contract documents to the parties. <br /> <br />City of Casselton Obligations: <br /> <br />1. To reimburse Cass County for all Engineering, Construction, and Administration costs associated with <br />the project above the County's $20,000 commitment. <br /> <br />2. To save and hold harmless the County for any loss of Federal Funding or other sanctions imposed on <br />the County by the Department of Transportation or Federal Highway Administration associated with the <br />project for any reason. <br /> <br />3. After the project is completed the City agrees to perform ali future maintenance, repair, and <br />reconstruction of the road at its sole expense. This includes, but is not limited to: <br /> <br />a. Maintaining the signing and marking of the project according to the current edition of <br /> the Manual on Uniform Traffic Control Devices for Streets and Highways, as <br /> supplemented and amended. <br />b. Prohibiting encroachments upon the right of way pursuant to 23 CFR Part 1.23, Rights of <br /> Way, and Part 713, Right of Way, The Property Management Function. <br /> <br />4. The City acknowledges that the sole purpose of placing the road on the Cass County system is to <br />secure Federal Funding. The City agrees to take over ownership of the Road at a future date to be <br />determined by Cass County. <br /> <br />5. NDDOT will make all construction contract payments on behalf of the County. The County will <br />reimburse the NDDOT for the non-federal portion of the project. The County will invoice the City for <br />payments and the City will make payments to the County. <br /> <br /> <br />
