parcels and rezone with building permit through Stanley Township.The township attorney, <br /> Jonathan Garaas supported the townships view that the township has full jurisdiction. <br /> 09/14/21—A Declaration of Covenants and Restriction and Community Access Easement for South Forty <br /> on 81'Addition was recorded by Bob Matthews and Vickie Matthews. <br /> 09/23/21—The Planning Commission us updated about the issues of the Matthews properties and the <br /> subdivision of land through the use of auditor's lots.This was an information item only at this <br /> time. <br /> 09/24/21—A Warranty Deed is recorded as document#1646367 conveying Auditor's Lot 7 from Robert <br /> &Vickie Matthews to Derek& Elizabeth Drege. <br /> 09/27/21—Grace Puppe was notified by the Recorder's Office that the Declaration of Covenants and <br /> Restriction and Community Access Easement for the South Forty on 81'was recorded. <br /> 09/28/21—Grace Puppe emailed Donald Kress from the City of Fargo to verify that the city has not <br /> extended its ET and that the property has not been platted through the City as"South Forty <br /> on 81St Addition". Donald Kress confirmed that neither has happened. <br /> 09/30/21—Grace Puppe mailed a violation letter to Robert &Vickie Matthews providing clarification on <br /> the county's authority to subdivide land and the township's authority to zone. Also included <br /> were possible penalties, to stop further development of the land until a proper subdivision <br /> application has been made and that if Matthews chooses to continue to not comply that the <br /> item will be considered of imposing a penalty. <br /> 10/13/21—Bob Matthews called Grace Puppe to set up a meeting with Jason Benson,Tracy Peters, and <br /> Grace Puppe. The meeting was scheduled for 10/26/21 at the Cass County Courthouse. <br /> 10/19/21—Bob Matthews and Todd Ellig showed at 1:50pm at the Cass County Planning Office to clarify <br /> questions with the Subdivision Ordinance and platting along with who the blame would fall <br /> on for the lots that were sold. <br /> 10/25/21—Grace Puppe emailed Bob Matthews a summary of what was discussed at the impromptu <br /> meeting on 10/19/21 and asked if any additional details or clarification needed to be added. <br /> Also included that the meeting for Tuesday, October 26 was still scheduled at the Cass <br /> County Courthouse to discuss the topic further. <br /> 10/28/21—An update was provided at the Planning Commission meeting as to the status of the <br /> Matthews property.The attorneys discussed adding this property issue to the existing <br /> litigation. If not, then there would be two judges which could provide different rulings. No <br /> action was taken until after the attorneys decide if they are going to join the existing case or <br /> go at it separately. <br /> 12/07/21—Grace Puppe received a phone call from a resident possibly interested in purchasing of the <br /> properties and was provided a brief summary off the current issues with the property. Grace <br /> Puppe noticed at this time that Auditor's Lot 6 was sold on 11/15/21 to William D & Marna <br /> Nelson.The Warranty Deed was recorded on 11/30/21 as document#1652718. <br /> Page 13 <br />
