<br />INTERGOVERNMENTAL SERVICE AGREEMENT (lGA) <br /> <br />THIS AGREEMENT is made and entered into this day of <br />2007, by and between Cass County Government, by and through the Cass County Sheriffs <br />Office, State of North Dakota (hereafter "CASS") and Clay County, a political subdivision of the <br />State of Minnesota, by and through the Clay County Sheriffs Office, State of Minnesota <br />(hereafter "CLAY"). <br /> <br />WITNESSETH, that for and in consideration of the mutual covenants and agreements <br />herein contained, the parties agree as follows: <br /> <br />1. Scope of Service: CASS shall provide a Class One correction facility for the holding <br />of prisoners, and all necessary and incidental services associated with such detention of <br />prisoners, at the Cass County Jail (hereafter "JAIL") located at Fargo, North Dakota. <br /> <br />CASS agrees in return for this payment to provide lodging facilities and programs for said <br />inmates. CASS will provide constant monitoring of the premises at all times that inmates are at <br />the facility. CASS will provide three (3) meals per day at normal meal times. The meals will be <br />nutritious prividing a weekly average of 3000 calories per day and in compliance with the most <br />recently published Recommended Dietary allowances and Dietary Reference Intakes for adult <br />males as established by the National Academy of Sciences. At least two (2) of these meals will <br />be hot meals. CASS will also provide the basic necessities to the inmates including but not <br />limited to beds, clean bedding, personal hygiene items, toilet facilities, inmate clothing, <br />recreation facilities as may be available, canteen facilities, visiting facilities, library and other <br />program services that may be available. <br /> <br />CASS County shall submit an invoice to the designated contact person at CLAY on a <br />monthly basis for the cost of occupied beds. The invoice will identify the inmate' name, date of <br />arrival, date of departure, total days in custody, and total cost. CASS shall also bill CLAY on a <br />monthly basis for all medical expenses, additional security costs, transportation expenses and <br />other costs incurred and provided for in this Agreement that are the responsibility of CLAY. <br /> <br />Page 1 of 9 <br />
