<br />SA Comments on IGA with Clay County for Jail Space <br /> <br />Paragraph 6: clerical correction to remove parentheses at end of paragraph <br /> <br />Paragraph 15: clerical corrections to change "the Provider" to "Cass" and to remove the <br />letter "u" from the word "behavioyrs" <br /> <br />Paragraph 24: <br />. "Free Press Guidelines": I understand what this is ... guidelines with the media <br />developed within North Dakota. I do not know if Clay County knows what these <br />guidelines are. I am unaware of whether Clay County has similar guidelines, or <br />different ones, or really even cares. If Clay knows, then fine. If not, then perhaps <br />we should provide them a copy. Ifit is something other than ND's informal <br />guidelines, then someone should let me know. <br />. Clerical corrections regarding "Provider" and "Buyer" to use the actual county <br />names <br /> <br />Paragraph 25: It refers to "Section 51.01(5) Stats" in relation to developmental <br />disability, without defining where that reference is found. Possibly it means Minnesota <br />Statutes, however that section of Minnesota Statutes relates to banking... so that <br />reference seems incorrect. There is no such section in the North Dakota statutes. Ifwe <br />are to leave a statutory reference there, then it requires correction and clarification. <br />However, the question is should we leave that reference? We can review those <br />references today and see how they fit with our current practices. However, there is no <br />mechanism, and no likelihood, that anyone in Cass will keep track of how things may <br />change in those Minnesota Statutes in the future, if those are Minnesota requirements. <br />Furthermore, I don't think the Jail is likely to change any of its hiring practices based <br />upon MN statutes. We follow ND's statutes. It makes more sense to me that Clay <br />County should review our non-discrimination requirements and verify they are satisfied <br />they meet their needs. Furthermore, I would not think the Jailor Cass Personnel is going <br />to post in conspicuous places notices setting forth the provisions ofMN statutes. I <br />understand we are already doing that for ND and federal requirements - I would not <br />anticipate anything else being done. Furthermore, we already include some similar <br />language in paragraph 9 - not sure why we are repeating things in this paragraph. <br /> <br />- Birch Burdick <br />
