Those developments not required to connect to a municipal system based on Section 6.09 <br />(a) (5) of this Ordinance may provide individual subsurface treatment systems subject to <br />applicable regulations of Fargo-Cass Public Health, all applicable state regulations and this <br />Ordinance. <br />a. Where on-site sanitary wastewater treatment facilities are utilized, each lot served <br />shall be of a size and shape to accommodate the necessary subsurface wastewater <br />treatment system at a safe distance from the water supply in accordance with <br />Fargo-Cass Public Health regulations and all other state or federal regulations. The <br />sewage treatment system shall be adequate to prevent serious health risks. This <br />system shall be detailed in a sewage treatment plan that is approved in accordance <br />with the rules, regulations and standards of the Environmental Health Office of the <br />Community Health Department of the City of Fargo, North Dakota and all other <br />applicable health regulations, including Cass County on-site sewage regulations <br />adopted March 4, 1993 and all subsequent amendments to said regulations. . <br />b. The lot shall provide a minimum area not less than forty thousand (40,000) square <br />feet. All applicable setbacks and floodway areas within the lot shall not be included <br />in the computation of the forty thousands (40,000) square foot minimum. <br />c. On-site sanitary wastewater treatment facilities shall be located on the highest <br />feasible area of undisturbed soils on all lots located within the one hundred (100) <br />year flood plain. <br />d. No on-site sanitary wastewater treatment facilities shall be located within the <br />floodway. <br />e. On-site sanitary wastewater treatment facilities shall only be constructed in areas of <br />undisturbed soils. <br />f. On-site sanitary wastewater treatment facilities located within the one hundred <br />(100) year flood plain shall include a valve system located between the storage tank <br />and drainfield used to close the drainfield during times of high or excessive water <br />inundating the drainfield. <br />g. On-site sanitary wastewater treatment systems shall not be less than one hundred <br />(100) horizontal feet from any water supply well less than fifty (50) feet in depth. <br />On-site sanitary wastewater treatment systems shall not be less than fifty (50) <br />horizontal feet from any water supply well greater than fifty (50) feet in depth. <br />h. On-site sanitary wastewater treatment facilities shall not be less than one hundred <br />(100) feet from any private or on-site water supply system serving three (3) or more <br />residences. <br />7. When connection to an existing sanitary sewer system is proposed: <br />a. The Preliminary Plat application shall include a statement from the authority or <br />organization providing such service that sufficient capacity to service the proposed <br />development is available. Such notice shall: <br />i. Be dated within six (6) months of the plan application <br />ii. Identify the term of the reservation
