21 <br /> <br />93. Non-Site Traffic. Vehicle trips passing within the study area as defined in the traffic impact <br />study that do not enter or exit the site and are generally the result of through traffic and <br />traffic generated by other developments. <br />94. Off-Street Parking. Parking spaces provided outside of the right-of- way of a street or <br />highway. <br />95. On-Street Parking. Parking spaces provided within the right-of-way of a street or highway. <br />96. Ordinance. The Cass County Subdivision Ordinance, as subsequently amended. <br />97. Parcel. See Lot. <br />98. Peak Hour. The hour during which the heaviest volume of traffic occurs on a road. <br />99. Pedestrian Way. A right-of-way, publicly or privately owned, intended for human movement <br />by walking or bicycling. <br />100. Personal Services. Establishments primarily engaged in providing services involving the care <br />of a person per a person’ personal goods or apparel. It includes uses such as barber shops, <br />beauty salons, shoe repair shops and dry cleaners. <br />101. Pervious Surface. Ground cover through which water can penetrate at a rate comparable to <br />that of water through undisturbed soils. <br />Plan. See Plat. <br />102. Planning Commission. See Cass County Planning Commission. <br />103. Plat. The map or plan of a subdivision, whether preliminary or final. <br />a. Preliminary Plat. A tentative drawing or map of a proposed subdivision meeting the <br />requirements herein enumerated. <br />b. Final Plat. A drawing or map of a subdivision meeting all the requirements of the <br />County and in such form as required by Cass County for the purpose of recording <br />(See Certificate of Survey). <br />104. Public Improvement. Any improvement or other facility for which a governmental unit may <br />ultimately assume responsibility for maintenance and operation. <br />105. Public Meeting. A forum held pursuant to Chapter 44-04-19 and Chapter 44-04-20 of the <br />North Dakota Century Code. <br />106. Public Utility. Any person, firm, corporation, municipal department, or board duly <br />authorized to furnish and furnishing, under public regulation, to the public, electricity, gas, <br />heat, power, steam, telephone, telegraph, transportation, or water. <br />107. Receiving Property. A parcel that receives a transferred development right from a <br />contiguous undeveloped quarter-quarter section or Legal Lot (See Sending Property) under <br />common ownership, as specified in Section 308 of this Ordinance. <br />108. Registered Engineer. An individual licensed and registered as a professional engineer under <br />the laws of the state of North Dakota. <br />109. Registered Land Surveyor. An individual licensed and registered as a professional land <br />surveyor under the laws of the state of North Dakota. <br />110. Restrictive Covenant. A restriction on the use of land usually set forth in the deed. <br />Retention Basin. A reservoir designed to retain storm water runoff with its primary release <br />of water being through the infiltration of said water into the ground. <br />111. Reverse Frontage Lot. A lot with front and rear street frontage, where vehicular access is <br />prohibited to and from the higher intensity street.
