<br />be responsible for all costs incurred by the County for the pavement <br />cleaning. <br /> <br />Persistent failure by the applicant to comply with this section will result in <br />Highway Department revoking the permit and taking any action necessary <br />to keep the pavement clean and drainage functioning properly. Should <br />the permit be revoked, there shall be a meeting with the applicant and <br />Highway Department to discuss what measures will be taken to reinstate <br />the permit <br /> <br />12.5.2.c <br /> <br />Erosion and Sedimentation Controls <br /> <br />The applicant shall minimize the erosion and sedimentation that occurs <br />during the construction of the access facility. The applicant shall develop <br />and implement and erosion control plan consistent with North Dakota <br />Department of Transportation (NDDOT) Erosion and Sediment Control <br />Handbook, as it presently exists or may hereafter be amended. <br /> <br />12.5.2.d <br /> <br />Damage to Utilities <br />Any damage caused to any utilities during construction shall be repaired <br />at the applicant's expense to the satisfaction of the authority owning such <br />utility. The Highway Department shall be notified immediately after <br />notification of the owner of the utility by the applicant, that damage has <br />occurred, and the applicant shall outline the steps to be taken to repair <br />the facility. <br /> <br />12.5.2.e <br /> <br />Winter Maintenance <br /> <br />No construction involving the widening of a County Highway will be <br />allowed to commence after September 15t!1. Construction may resume <br />when the asphalt plants open the following spring. <br /> <br />Prior to the suspension of construction for the winter months, the applicant shall contact <br />the Highway Department The Highway Department shall perform a field inspection to <br />identify any potential winter maintenance problems, The applicant shall correct any <br />problems identified by the Highway Department to the satisfaction of the Highway <br />Department The applicant shall be solely responsible for all costs to correct any <br />problems identified by the Highway Department <br /> <br />31 <br />
