be responsible for all costs incurred by the County for the pavement cleaning. Persistent failure by the applicant to comply with this section will result in Highway Department revoking the permit and taking any action necessary to keep the pavement clean and drainage functioning properly. Should the permit be revoked, there shall be a meeting with the applicant and Highway Department to discuss what measures will be taken to reinstate the permit 12.5.2.c Erosion and Sedimentation Controls The applicant shall minimize the erosion and sedimentation that occurs during the construction of the access facility. The applicant shall develop and implement and erosion control plan consistent with North Dakota Department of Transportation (NDDOT) Erosion and Sediment Control Handbook, as it presently exists or may hereafter be amended. 12.5.2.d Damage to Utilities Any damage caused to any utilities during construction shall be repaired at the applicant's expense to the satisfaction of the authority owning such utility. The Highway Department shall be notified immediately after notification of the owner of the utility by the applicant, that damage has occurred, and the applicant shall outline the steps to be taken to repair the facility. 12.5.2.e Winter Maintenance No construction involving the widening of a County Highway will be allowed to commence after September 15t!1. Construction may resume when the asphalt plants open the following spring.
