<br />12.4 Responsibility for Improvements <br /> <br />Regardless of contracts, agreements, or inspections performed, the responsibility for the installed <br />improvements required by this Ordinance shall rest solely with the applicant. The total cost of all <br />construction and maintenance of the work specified shall be borne by the applicant. <br /> <br />12.5 Construction of Improvements <br /> <br />12.5.1 General Requirements <br /> <br />Construction of improvements required by this Ordinance shall be in accordance with the <br />rules, regulations, and specifications as set forth in this Ordinance. <br /> <br />The construction of any improvements within the right-of-way shall not commence until an <br />access permit is issued. <br /> <br />The construction of improvements must begin within six months of the date of issuance of <br />an access permit and must be completed within 12 months of the issuance of an access <br />permit. These time periods may be extended by the County Engineer upon receipt of a <br />written request detailing sufficient cause. <br /> <br />12.5.2 Maintenance during Construction <br /> <br />12.5.2.a <br /> <br />12.5.2.b <br /> <br />Emergency Work <br />If any emergency repairs or actions are required of the Highway <br />Department on a County Highway due to construction of an improvement <br />as approved by this Ordinance, the Highway Department may perform <br />such emergency repairs or actions and charge the applicant for all the <br />costs associated with such work. <br /> <br />Debris Removal <br />The applicant shall be responsible for cleaning and maintaining the right- <br />of-way of the County Highway. The pavement surface shall be kept clean <br />and free of mud, gravel, debris, trash, and other extraneous material at all <br />times. Should the applicant fail to keep the pavement clean and free of <br />mud and debris or the drainage functioning properly, the County shall <br />have the right, but not the duty to clean the pavement and restore <br />drainage to maintain a safe and passable highway.
