<br />12.6 Final Inspection and Acceptance <br /> <br />Upon written notification by the applicant or the applicant's representative that the construction <br />has been completed and the submission of all required reports, the Highway Department shall <br />perform a final inspection. Prior to final approval and acceptance by the Highway Department, the <br />applicant shall correct any deficiencies noted by the Highway Department. <br /> <br />At such time as all work has been done to the complete satisfaction of the Highway Department, <br />the performance guarantee shall be released. <br /> <br />CHAPTER 13 <br /> <br />Performance Guarantees <br /> <br />13.1 Performance Guarantees <br /> <br />An acceptable Performance Guarantee to protect the County Highway System and to ensure <br />compliance with this Ordinance and with issued permits shall be provided prior to the issuance of <br />a permit as provided for in this Ordinance, A Performance Guarantee shall be in the form of a <br />cash bond for all Permanent and Field access permits and all Temporary access permits <br />constructing a new access or temporally modifying an existing access. The County Engineer <br />shall be, and is hereby authorized to act for the County in all matters relating to Performance <br />Guarantees. The County Engineer may, upon receipt of written application from an applicant <br />substantiating good and reasonable cause, waive this requirement. <br /> <br />13.1.1 Cash Bond <br /> <br />All cash bonds posted shall be a minimum of $1000 dollars for the construction or <br />modification of all access facilities and this amount may be increased at the discretion of <br />the County Engineer. The cash bond shall be made payable to the Highway Department <br />and shall be submitted to the County Engineer. The type of cash bond provided may be a <br />Cashier's Check, Bank Draft, Certified Check, or Bank Money Order. <br /> <br />13.1.2 Default <br /> <br />If the applicant fails to perform the work with sufficient work force and equipment or with <br />sufficient materials to insure the completion of said work within the specified time, or <br />performs the work unsuitably as determined by the County Engineer, or neglects or <br />refuses materials or performs anew such work as shall be rejected as defective and <br />unsuitable, or discontinues the execution of the work, or for any other cause whatsoever <br />does not carry on the work in an approved manner, the County Engineer shall give notice <br />32 <br />
