<br />Commission Minutes-October 16, 2006 3138 <br /> <br />The chairman opened the public hearing and invited comments from the audience. Hearing <br />none, the public hearing was closed. <br />Mr. Wagner moved and Mrs. Sorum seconded to adopt Resolution #2006- <br />14 Giving Final Approval to the Issuance of Multifamily Housing Revenue <br />Bonds (Sisters of the Presentation BVM Project) Series 2006. On roll call <br />vote, the motion carried unanimously. <br /> <br />7. ABATEMENT HEARING, Application partially approved for Randy Goodman <br />Frank Klein, Director of Equalization, was present. He reviewed his investigation of the <br />abatement application filed by Randy Goodman for property located at 204 4th Avenue West <br />in Hunter, North Dakota. The applicant is requesting the valuation be reduced from <br />$109,300 to $90,000 total true and full value for 2005. According to the application, in <br />July, 2004, Mr. Goodman paid $90,000 for the home. The City of Hunter denied the <br />abatement for 2005 and the city board of equalization denied an appeal for 2006; however, <br />the city did not raise the previous assessment of $109,300, whereas most other values were <br />increased for 2006. <br /> <br />Randy Goodman, applicant, was present. He said his assessment was raised from $90,000 <br />in 2004 to $109,300 in 2005. He does not feel his property is worth the value placed on it <br />by the city assessor. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded that abatement #4287 for <br />Randy Goodman be approved in part at a valuation of $99,000, as <br />recommended by the Director of Equalization. Discussion: Mr. Pawluk <br />said that by lowering the value to $99,000, the county is allowing for a <br />modest increase in valuation and feels the assessment is fair. On roll <br />call vote, the motion carried unanimously. <br /> <br />8. SPIRITWOOD ENERGY PARK, Letter of support to be sent to Stutsman County <br />Mr. Bennett said correspondence was received a few months ago from Stutsman County <br />regarding Spiritwood Energy Park, a development project in their county, with a request for <br />a $5,000 contribution to help fund a transportation study of the roads impacted by the <br />project. The request for funding has been withdrawn; however, the Jamestown/Stutsman <br />Economic Development Corporation would appreciate a letter of support. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Vanyo seconded to send a letter to Stutsman <br />County offering support for a regional transportation study of the <br />Spiritwood Energy Park. On roll call vote, the motion carried <br />unanimously. <br /> <br />9. PUBLIC COMMENT ON COUNTY BEER LICENSE, Item tabled <br />Last year, the commission considered an application for a county beer license submitted by <br />Rodney Ballinger Enterprises, doing business as Bear Creek Winery south of Fargo. He <br />operates a domestic winery in Stanley Township. The state's attorney recommended the <br />commission not approve the license due to zoning issues relating to the City of Fargo, since <br />the business lies within the city's extraterritorial boundaries. <br /> <br />Mr. Bennett said initially Rodney Ballinger requested to be placed on the agenda to discuss <br />this item; however, today Mr. Ballinger called and asked that this item be tabled. Mr. Burdick <br />said his office is sending a letter today requesting an Attorney General's opinion on this <br />issue. <br />
