<br />Commission Minutes-August 7,2006 3089 <br /> <br />6. CONTRACT, Approved with G & R Controls <br />MOTION, passed <br />Mr. Wagner moved and Mrs. Sorum seconded to approve the contract with <br />G & R Controls with the following amendment: delete the paragraph which <br />would allow the contract to automatically renew in February of 2007. On roll <br />call vote, the motion carried unanimously. <br /> <br />7. FARGO MUNICIPAL AIRPORT AUTHORITY, Funding request approved <br />Keith Berndt, County Engineer, and Shawn Dobberstein, Executive Director Hector Airport <br />Authority, were present. Mr. Berndt stated a bridge crossing drain 10 on the west side of <br />the airport terminal at 32nd Avenue North needs to be replaced to repair an embankment <br />failure threatening one or more airport buildings. Southeast Cass Water Resource District <br />and the Airport Authority have researched options and found the drain relocation to be most <br />cost effective. The estimated project cost is $640,000 with $400,000 for bridge replacement <br />and $240,000 for channel work. <br /> <br />Mr. Berndt said in accordance with North Dakota Century Code, the county generally funds <br />40% of local cost of bridge replacements on legal drains for county and township roads. In <br />this case the county cost would be $160,000. The bridge is located on a section line and <br />crosses a legal drain on property owned by the City of Fargo Airport Authority and the road <br />is usually gated. Mr. Wagner questioned if county participation is a deviation from policy as <br />this concerns the Airport Authority and asked what has been done in the past. Mr. Berndt <br />replied in the past, the county has partnered with both the Cities of Fargo and West Fargo <br />on bridge projects. <br /> <br />Mr. Wagner asked who appoints members to the Airport Authority Board. Mr. Dobberstein <br />replied the board was created in 1969 by the City of Fargo; the members serve five-year <br />terms and are appointed by the mayor and approved by the city commission. The board <br />has their own mill levy of two mills. He stated that Southeast Cass Water Resource District <br />will participate financially and the City of Fargo has been approached as well. <br /> <br />Mr. Wagner asked where county funds would come from should the county participate. Mr. <br />Berndt replied from monies in the bridge fund. Mr. Vanyo asked Mr. Berndt why he <br />changed his mind when initially he was reluctant to participate financially. Mr. Berndt said <br />after he visited the site, he realized the gate entrance was for the airport, not to a private <br />residence and now sees the necessity of the project. Mr. Bennett clarified the breakdown of <br />proposed participating entities in the cost share of the project and the amounts they would <br />be contributing as follows: Cass County $160,000; City of Fargo $100,000; Southeast Cass <br />Water Resource District $230,000; and Airport Authority $150,000. <br /> <br />MOTION, passed <br />Mr. Vanyo moved and Mr. Wagner seconded to authorize county <br />participation in the amount of 40% of the bridge replacement cost not to <br />exceed $160,000 to replace a bridge over Drain 10 on 32nd Avenue North, <br />Fargo. Discussion: Mr. Wagner stated he is supporting county <br />participation as the airport serves a larger region than just the City of <br />Fargo. Mr. Pawluk said as he serves as the chairperson for the Airport <br />Authority, he will abstain from voting. On roll call vote, the motion <br />carried with four members voting in favor, and Mr. Pawluk abstaining. <br />
