<br />No rate adjustment shall be effective until a formal written modification to this Agreement is <br />issued and signed by the DOCR. In no event shall rates be approved retroactively, <br /> <br />ARTICLE IX - FINANCIAL PROVISIONS <br /> <br />In consideration of the Contractor's satisfactory performance of services called for under this <br />IGA, the DOCR shall reimburse the Contractor at the fixed rate indicated on Page 1 of the <br />IGA. The rate covers one offender per person-day. <br /> <br />The Contractor may bill the DOCR for the day the offender is admitted to the contract <br />facility, but not for the day of discharge from the facility. <br /> <br />The Contractor shall bill for services provided on a monthly basis. Monthly billings shall list <br />each DOCR offender, the specific dates of confinement for each, and the total days to be <br />reimbursed, the agreed upon rate per day and the total amount billed (total days multiplied by <br />the rate per day). The DOCR will submit payment within 30 days of billing. <br /> <br />Contractor shall submit invoice to the following: <br /> <br />For Parole Violators <br />Michelle Wagner <br />Division of Field Services <br />PO Box 5521 <br />Bismarck, NO 58506-5521 <br /> <br />Invoice shall include FULL NAME (last first middle), DOB, SID, Arresting or Referring <br />Officer/Agency <br /> <br />ARTICLE X - SPOLIATION - NOTICE OF POTENTIAL CLAIMS <br /> <br />The Contractor shall promptly notify the DOCR of all potential claims which arise or result from <br />this contract. The Contractor shall also take all reasonable steps to preserve all physical <br />evidence and information which may be relevant to the circumstances surrounding a potential <br />claim, while maintaining public safety, and grants to the state of North Dakota the opportunity <br />to review and inspect the evidence, including the scene of an accident. <br /> <br />ARTICLE XI-INDEMNITY <br /> <br />The Contractor and the DOCR each agrees to assume its own liability for any and all claims of <br />any nature including all costs, expenses and attorney's fees which may in any manner result <br />from or arise out of this agreement. <br /> <br />ARTICLE XII-INSURANCE <br /> <br />The Contractor shall secure and keep in force during the term of this agreement, from an <br />insurance company, government self-insurance pool or government self-retention fund <br />authorized to do business in North Dakota, commercial general liability insurance with <br />minimum limits of $250,000 per person and $500,000 per occurrence, The DOCR shall <br /> <br />Page 4 <br />
