<br />In the event of an escape or attempted escape, the Contractor shall immediately notify the <br />Warden, the Warden's designee, or the supervising parole and probation officer of the escape <br />or attempted escape, <br /> <br />ARTICLE VI - PERIOD OF PERFORMANCE <br /> <br />This IGA shall be in effect through June 30, 2007 or until earlier terminated by either party, <br />Either party may terminate this agreement upon thirty days notice in writing to the other party. <br />Should conditions of an unusual nature occur making it impractical, uneconomical, or <br />undesirable to continue housing DOCR offenders, the Contractor may suspend the use of <br />facility by giving thirty (30) days written notice to the Director of the DOCR. Notice shall be by <br />certified mail and addressed to the Director, DOCR, 3100 Railroad Avenue, PO Box 1898, <br />Bismarck, ND 58502-1898, The thirty-day notice period shall be computed from the date of <br />mailing the notice, <br /> <br />ARTICLE VII-TERMINATION OF AGREEMENT FOR LACK OF FUNDING OR AUTHORITY <br /> <br />It is agreed that in the event appropriations to the DOCR are not obtained and continued at a <br />level sufficient to allow for payments to the Contractor, for the services identified in this <br />Contract the obligations of each party hereunder may be terminated at the option of the <br />DOCR, provided that any such termination shall be without prejudice to any obligations or <br />liabilities of either party already accrued prior to such termination, <br /> <br />The DOCR may terminate this contract effective upon delivery of written notice to the <br />Contractor, or on any later date stated in the notice, under any of the following conditions: <br /> <br />1) If funding from federal, state, or other sources is not obtained and <br />continued at levels sufficient to allow for purchase of the services or supplies in <br />the indicated quantities or term. The contract may be modified by agreement of <br />the parties in writing to accommodate a reduction in funds. <br /> <br />2) If federal or state laws or rules are modified or interpreted in a way that <br />the services are no longer allowable or appropriate for purchase under this <br />contract or are no longer eligible for the funding proposed for payments <br />authorized by this contract. <br /> <br />3) If any license, permit or certificate required by law or rule, or by the terms <br />of this contract, is for any reason denied, revoked, suspended or not renewed. <br /> <br />Termination of this contract under this subsection is without prejudice to any obligations or <br />liabilities of either party already accrued prior to termination. <br /> <br />ARTICLE VIII - PROSPECTIVE PRICE RE-DETERMINATION <br /> <br />The rate may be re-negotiated not more than once every twelve (12) months following the <br />commencement date of the IGA. The Contractor may initiate a request for a rate increase or <br />decrease by notifying the DOCR in writing at least 30 days prior to the desired effective date of <br />the adjustment. The Contractor agrees to provide additional cost information to support a rate <br />increase and to permit an audit of accounting records upon request of the DOCR. <br /> <br />Page 3 <br />
