<br />secure and keep in force during the term of this agreement, from an insurance company, <br />government self-insurance pool or government self-retention fund authorized to do business in <br />North Dakota, commercial general liability insurance with minimum limits of $250,000 per <br />person and $1,000,000 per occurrence. <br /> <br />ARTICLE XIII -INSPECTION AND TECHNICAL ASSISTANCE <br /> <br />The DOCR agrees that the Contractor's correctional facility currently meets DOCR's <br />requirements for conditions of confinement and levels of selVices. The Contractor agrees to <br />allow periodic inspections of the facility by officials from the DOCR. The DOCR shall advise <br />the facility administrator of its findings upon inspection in order to promote improvements to <br />facility operations, conditions of confinement, and levels of selVices. <br /> <br />The Contractor agrees to provide information regarding its operations when requested by the <br />DOCR on a monthly basis. The Contractor may provide the requested information when it <br />submits its monthly billing to the DOCR. <br /> <br />ARTICLE XIV - COMPLIANCE WITH LAWS <br /> <br />The Contractor shall comply with all applicable laws, rules regulations and policies, including <br />but not limited to those relating to nondiscrimination, accessibility, and civil rights. The <br />Contractor shall ensure that it will at all times during the term of this contract and any <br />extensions thereof be in full compliance with the Americans with Disabilities Act (Public Law <br />101-336, 104 Stat. 327, U,S,C. 12101-12213, and 47 U.S.C. 225 and 611) and any <br />amendments thereto, <br /> <br />ARTICLE XV-COMPLIANCE WITH PUBLIC RECORDS LAWS <br /> <br />The Contractor acknowledges that its offender records are subject to the provisions of <br />N.D.C.C. ~ 12-44.1-28. The Contractor shall comply with the provisions of North Dakota's <br />open records laws, subject to the restrictions and limitations of N.D.C.C. ~ 12-44.1-28, <br /> <br />ARTICLE XVI-NOTICE <br /> <br />Any notice required or permitted to be given pursuant to this agreement may be personally <br />selVed on either party by the party giving such notice, or may be selVed by certified mail, <br />return receipt requested, addressed to the executive office of the party upon whom selVice is <br />made. <br /> <br />ARTICLE XVII-INTEGRATION AND MODIFICATION <br /> <br />This contract constitutes the entire agreement between the Contractor and the DOCR. No <br />alteration, amendment, or modification in the provisions of this agreement shall be effective <br />unless it is reduced to writing, signed by the parties and attached hereto. <br /> <br />Page 5 <br />
