<br />Commission Minutes-March 20, 2006 3047 <br /> <br />In 1994, the fee was extended through a resolution passed by the County Commission. <br />Then in 2000, a question was put on the ballot to increase the fee to $1.00 and was <br />approved by county voters. <br /> <br />Mr. Montplaisir encouraged the commission to retain the $1.00 fee. The funds that are <br />collected pay for the county's annual contract with the Red River Valley Regional Dispatch <br />Center in the amount of $265,000. He said the commission may choose to put the question <br />on the ballot again or approve a resolution to extend the fee. <br />MOTION, passed <br />Mr. Wagner moved and Mrs. Sorum seconded to adopt Resolution <br />#2006-4, extending the current 911 fee for another six years to end on <br />December 1, 2012. Discussion: State's Attorney Birch Burdick said the <br />resolution does not appear to conflict with state law outlining the 911 fee. <br />On roll call vote, the motion carried unanimously. <br /> <br />RESOLUTION #2006-4 <br />ADOPTING EXCISE TAX FOR EMERGENCY SERVICE COMMUNICATIONS <br />SYSTEM E-911 <br /> <br />WHEREAS, The North Dakota State Legislature in Chapter 57-40.6 of the North Dakota <br />Century Code has a process by which counties can generate income through an excise tax <br />on the use of telephone access lines and wireless service in order to finance an emergency <br />911 telephone system; and <br /> <br />WHEREAS, The citizens of Cass County voted to implement an emergency 911 telephone <br />system in 1988 and to levy a $.50 per access line; and <br /> <br />WHEREAS, The citizens of Cass County voted to implement an emergency 911 telephone <br />system in 2000 and to levy a $1,00 per access line; and <br /> <br />WHEREAS, The Board of County Commissioners of Cass County extended the emergency <br />911 telephone levy to wireless service in 2001 as allowed by Chapter 57-40.6 of the North <br />Dakota Century code to finance upgrades to the infrastructure necessary to provide wireless <br />enhanced 911 service; and <br /> <br />WHEREAS, The Board of County Commissioners of Cass County deems it to be a health <br />and safety benefit for the county to continue to have an emergency 911 telephone system; <br />and <br /> <br />WHEREAS, The Board of County Commissioners of Cass County are facing increased costs <br />for operation of the emergency 911 telephone system; and <br /> <br />WHEREAS, The North Dakota State Legislature in Chapter 57-40.6 of the North Dakota <br />Century Code requires the continuation of the excise tax to be accomplished by a resolution <br />of the Board of County Commissioners; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners, of Cass <br />County, North Dakota, as follows: <br /> <br />That the County of Cass continue with the emergency 911 telephone system established in <br />1988 and extended to wireless service in 2001 for the safety of the citizens of Cass County. <br />
