<br />Commission Minutes--September 20, 1999 2045 <br /> <br />WHEREAS, 24-05-09 and 24-05-10 of the North Dakota Century Code authorize the Board of <br />Commissioners to purchase, acquire, take over, or condemn under the right and <br />power of eminent domain, for such county, any and all lands which it deems <br />necessary for improving any highway; <br /> <br />NOW THEREFORE, Be it resolved by the Cass County Board of Commissioners that taking of <br />the land in Warren Township as described below is hereby declared a public necessity. A <br />special board consisting of the County Auditor, the County Treasurer and the County Register <br />of Deeds shall fix the damages for the taking. <br /> <br />That part of the Southeast Quarter of Section 24, Township 138 North, Range 50 West of the <br />5th Principal Meridian, Cass County, North Dakota, described as follows: <br /> <br />Commencing at the Southeast corner ofthe Southeast Quarter of said Section 24; Thence North <br />89 degrees 39 minutes 33 seconds West (assumed bearing) along the Southerly line of the <br />Southeast Quarter of said Section 24 for a distance of 1000.75 feet; thence North 00 degrees <br />20 minutes 27 seconds East for a distance of 33.00 feet, to a point of intersection with the <br />Northerly right-of-way line of Cass County Highway No. 14 and the true point of beginning; <br />thence North 66 degrees 20 minutes 36 seconds west for a distance of 497.79 feet; thence <br />North 80 degrees 34 minutes 04 seconds West for a distance of 315.35 feet; thence North 01 <br />degrees 10 minutes 40 seconds East for a distance of 47.93 feet, to point of intersection with <br />the Southerly right-of-way line of the Red River Valley and Western Railroad; thence <br />Southwesterly along the Southerly right-of-way of said railroad for a distance of 908.14 feet, <br />more or less, to a point of intersection with a line 33.00 feet northerly of (as measured <br />perpendicular to) the Southerly line of the Southeast Quarter of said Section 24; thence South <br />89 degrees 39 minutes 33 seconds East along said line, parallel to and 33.00 feet Northerly of <br />(as measured perpendicular to) the Southerly line of the Southeast Quarter of said Section 24 <br />for a distance of 1533.31 feet to the true point of beginning. <br /> <br />Said tract contains 5.172 acres, more or less, and is subject to easements as may be of record. <br /> <br />Dated at Fargo, North Dakota, this 20th day of September, 1999. <br /> <br />11. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Meyer moved and Mr. Wieland seconded to approve Voucher No. <br />132,061 through No. 132,640. On roll call vote, motion carried <br />unanimously. <br /> <br />12. EMPLOYEE DEFERRED COMPENSATION; MEETING UPDATES; NDACO CONVENTION; <br />FAX MACHINES, Committee reports <br />Bonnie Johnson, County Coordinator, said three meetings have been arranged for county <br />employees to obtain further information from representatives of the North Dakota Public <br />Employees Retirement System regarding the Portability Enhancement Provision (PEP) <br />approved by the board at the last meeting. The meeting schedule is as follows: October 26 at <br />11 :00 AM and November 15 at 10:00 AM in the Cass County Annex basement meeting room; <br />November 18, 11 :00 AM, at the Cass County Highway Department. <br />
