<br />Commission Minutes--September 20, 1999 2044 <br /> <br />determination of maximum speed on certain highways within their <br />jurisdiction on the basis of an engineering and traffic investigation. <br />Mr. Berndt said the traffic volume has increased on this road, but it is <br />still below national standards for a two-lane road and he encouraged <br />the board to proceed with the recommended study. Mr. Wieland <br />suggested looking at other roads in the metropolitan area in the near <br />future. At the call for the question and upon roll call vote, motion <br />carried unanimously. Mrs. Quick resumed as Chairperson. <br /> <br />MOTION, passed <br />Mr. Wieland moved and Mr. Koenig seconded to delay implementation <br />of Resolution #1999-15 regarding advance signing of a 25 ton bridge <br />and reducing vehicle speeds to 40 miles per hour, until such time as <br />the study is completed and further action is required. On roll call <br />vote, motion carried unanimously. <br /> <br />10. RESOLUTION #1999-16, Declaring public necessity to take land for slide repair <br />Mr. Berndt provided information on the County Highway 14 slide repair project in Section 24, <br />Warren Township. He cited a need to move the road further from the river, which necessitates <br />taking a pie-shaped parcel of land (5.172 acres) owned by Mickeal Fosse and other family <br />members. The property was appraised at $1,180 per acre, however, no agreement has been <br />reached for the sale of the property. <br /> <br />Mr. Fosse was present today, along with his mother, and he feels the county has not done <br />anything in the past to maintain the curve in the road and said it should have been backfilled <br />and rip rapped to prevent the erosion. His mother does not wish to sell this land because she <br />wants to maintain a certain number of acres, and Mr. Fosse suggested that the county purchase <br />one of two other properties adjoining his mother's land that are for sale and then trade with her <br />for the land needed to repair the slide area. <br /> <br />Commissioners and staff reviewed the State law concerning condemnation proceedings with <br />Mr. Fosse. Mr. Berndt said he will review drainage concerns with Mr. Fosse, and he said the <br />project does include a considerable amount of rip rap to prevent future erosion. <br />MOTION, passed <br />Mr. Koenig moved and Mrs. Schneider seconded to authorize the <br />chairperson to sign the following Resolution #1999-16 declaring <br />necessity to take land for County Highway 14 slide repair. On roll call <br />vote, motion carried unanimously. <br /> <br />RESOLUTION #1999-16 DECLARING PUBLIC NECESSITY TO TAKE LAND <br />WHEREAS, Plans have been prepared to reconstruct County Highway 14 and repair the slide <br />in Section 24, Warren Township; <br /> <br />WHEREAS, Additional property in Section 24 of Warren Township is required to repair <br />roadway to appropriate engineering standards; <br /> <br />WHEREAS, The Board of County Commissioners has been unable to purchase the land <br />required at a price which the board deems reasonable; <br />
