Commission Minutes--ApriI19, 1999 1969

county may sell it at a public sale to the highest bidder, assuming the county felt the highest bid
was sufficient.

Frank Klein, County Director of Tax Equalization, was present today after being informed of this
situation. He believes the value of the property in question would be less than $1,000.00 since
it is abandoned right-of-way for which the county does not have an abstract, and there would be
a cost involved in obtaining a warranty deed.
MOTION, tabled
Mrs. Schneider moved and Mr. Meyer seconded to approve the sale of
property in the SE 1/4 of Section 15, Township 140 North, Range 49
West, no longer used as highway right-of-way, and as described on
the quit claim deed provided by the County Engineer, for the sum of
$500.00. Discussion: Mr. Koenig suggested a selling price of $300.00
for this 3.3 acres of former highway right-of-way. He doubted there
would be any interest in the property, other than the adjoining
landowner. Mrs. Holmquist then presented some documents from the
North Dakota Department of Transportation concerning the abandoned
right-of-way. At this point, the Board agreed to table the motion
momentarily until the State's Attorney has an opportunity to examine
the documents presented by Mrs. Holmquist.

11. ABATEMENT APPLICATION, Warren Dubbels
Frank Klein reported on his investigation of the abatement application of Warren Dubbels. He
recommends denying the abatement because the 1997 valuation was already reduced because
of flood damage to the unfinished basement. The Stanley Township Board also recommends
denying the abatement based upon a report from the Stanley Township Assessor.

Mr. Dubbels was present and addressed the Board at this time. He said flood water filled his
basement in 1997 to within an inch or two of the floor joists, and water in the out-buildings was
chest-high. Mr. Dubbel's concern is that the taxes were reduced for one year and then went back
up in 1998 and 1999.

Mr. Klein said the abatement application requests that the 1997 valuation be reduced to
$38,900. The township assessor lowered the valuation by $21,000 to $63,300 because of the
1997 flood, and the valuation increased after everything was put back in order. Mr. Klein said
the property has value because it is a rural setting with 21 acres of land along the Red River,
and development is occurring in the neighborhood.
MOTION, passed
Mr. Meyer moved and Mrs. Schneider seconded that Abatement #4121
be denied for Warren Dubbels as recommended by the Director of
Equalization and the Stanley Township Board. On roll call vote,
motion carried unanimously.

12. ABATEMENT APPLICATION, Clifton & Donna Rodenburg
Frank Klein reported on his investigation of the abatement application of Clifton & Donna
Rodenburg. He said it appears that sometime in the future, the owners may have to move their
residence forward on the lot or move it to a different location because the river bank has
experienced sliding for a number of years. The Stanley Township Board recommends denying
