10. <br /> <br />Commission Minutes--March 1, 1999 1948 <br /> <br />be given the bridge on the condition that they make all reasonable efforts to preserve the <br />structure and place a plaque on it showing its historical significance. MOTION, passed <br /> Mr. Koenig moved and Mr. Meyer seconded to authorize the donation <br /> of a Pontiac Township Bridge to the Enderlin Golf Course according <br /> to the conditions outlined in an agreement to be signed by the <br /> Commission Chair. On roll call vote, motion carried unanimously. <br /> <br />DEED TRANSACTION DELAYED, Hiqhway 81 right-of-way <br />This item was moved from the consent agenda to the regular agenda for discussion. Mr. Berndt <br />recommended deeding approximately three acres of old right-of-way along Highway 81 in the <br />SEN of Section 15, Reed Township, back to the adjacent landowner, Luella Holmquist, because <br />the property is no longer used as highway right of way. <br /> <br />Mr. Meyer asked if the county could be compensated for the property at the purchase price <br />when it was acquired. In a letter to the County Engineer from the former State's Attorney, it was <br />stated that the county paid $296 for acquisition of the property. The Board questioned whether <br />the land has value to anyone other than the adjacent landowner. <br /> <br />Birch Burdick, State's Attorney, said he has not done any study to determine if the county has <br />legal interest or ownership in the property, however, the quit claim deed would be granting <br />whatever interest the county may have, subject to any conditions that may be upon it. <br /> MOTION, passed <br /> Mr. Meyer moved and Mr. Koenig seconded to delay action on the quit <br /> claim deed concerning property in the SE 1/4 of Section 15 Township <br /> 140 North Range 49 West, no longer used as highway right-of-way, <br /> until further review and recommendation by the State's Attorney. <br /> Discussion: Mr. Meyer said he is interested in the legal ownership of <br /> the property and if anyone else would be interested in it, other than <br /> the former owner. Motion carried. <br /> <br />FLOOD UPDATE, Acquisition project close-out; River Keepers input <br />The County recently received a letter from the North Dakota Division of Emergency <br />Management asking that Cass County finalize all housing acquisitions including demolition by <br />May 31, 1999. Mrs. Quick asked Irv Rustad, Lake Agassiz Regional Council, to appear before <br />the Board for an update. Mr. Rustad said he has an advertisement in the newspaper for the <br />sale of the most recently acquired properties, and he has been contacted by three moving <br />companies about the deadline. He has talked to the County Engineer about spring road <br />restrictions, and Commissioners were in agreement that some of the homes may have to be <br />moved off their foundations and temporarily placed on other county-owned lots in the interim <br />so the demolition work can be completed and holes filled up with dirt. Once spring road <br />restrictions are lifted, the homes can be moved to the buyer's permanent location. <br /> <br />Regarding the disposition of county buy-out properties, Keith Berndt has been contacted by Bob <br />Backman, Executive Director of River Keepers, who was present today to talk about future uses. <br />Mr. Backman shared some ideas with the Commission on possible uses, such as green space, <br />bike paths, bird sanctuaries, wildlife learning sites, primitive rest areas for those canoeing the <br />Red River, as well as the possibility of facilitating planting of trees and shrubs by student <br /> <br /> <br />
