<br />Commission Minutes--October 19, 1998 1883 <br /> <br />11. TAX-FORFEITED PROPERTY, Appraisal/hearing date <br />Michael Montplaisir, County Auditor, provided a list of real estate forfeited to Cass County for <br />delinquent taxes, pursuant to North Dakota Century Code Chapter 57-28. The list contains <br />eleven parcels and gives a minimum sale price for each legal description. A number of lots in <br />the Meadowbrook Park Subdivision were omitted at the request of the County Planning Office <br />and County Commission action on October 5, 1998, due to drainage and sewage problems. <br /> <br />Mr. Wieland said he has been contacted by someone who is interested in purchasing three lots <br />in Meadowbrook Park Subdivision, and the Commission may receive a memo asking for further <br />discussion in spite of the moratorium on selling those lots. <br />MOTION, passed <br />Mr. Wieland moved and Mr. Koenig seconded to set the value of the <br />tax forfeiture properties as outlined in the list provided by the County <br />Auditor's Office; and to set the hearing date on the value of property <br />as November 2,1998, at 3:30 PM in the Commission Room, Cass <br />County Courthouse. On roll call vote, motion carried unanimously. <br /> <br />12. FLOOD UPDATE, Report by Irv Rustad: Flood Master Plan Committee update <br />Irv Rustad, Lake Agassiz Regional Development Corporation, provided a financial update of <br />FEMA and HUD funds allocated and spent since the 1997 spring flood. The program income <br />balance is $171,067.47, and funds available for Phase II buyouts total $2,799,491.23. <br />Seventeen appraisals have been completed for Phase II buyouts at an estimated cost of <br />$2,290,125, according to a second hand-out from Mr. Rustad. Also, he learned that property <br />owners whose homes were bought out by the county are eligible for a refund of their flood <br />insurance premiums so his office is sending notices to those individuals. <br /> <br />Commissioner Quick and Keith Berndt, County Engineer, gave an update on the progress of <br />the Flood Master Plan Committee, which was formed about a year ago in response to the 1997 <br />flood. The committee has received reports from their consultant, Moore Engineering, and the <br />last one provided specific recommendations on flood protection, according to Mrs. Quick. <br /> <br />The Flood Master Plan Committee voted to accept the preliminary recommendations from <br />Moore Engineering on the Phase I and Phase II souths ide flood protection, and Mr. Berndt said <br />the Southeast Cass Water Resource District has agreed to consider its implementation using <br />their legal authority to special assess the affected landowners, since their boundaries include <br />the City of Fargo and this part of rural Cass County in the flood study. He has also met with <br />the Fargo Public Works Project Evaluation Committee. <br /> <br />Some funds may be needed to pay up-front costs for additional administrative and engineering <br />expenses that the Southeast Cass Water Resource Board may be incurring that would not be <br />recouped if the project is not approved by the homeowners. Mr. Berndt asked the board to <br />authorize funding the County Road 21 project near St. Benedict using $100,000 of county road <br />funds and modify the HUD action plan in order to designate $100,000 for these upfront flood <br />mitigation expenses. The County has requested additional funds and is waiting for a response <br />from the State Disaster Emergency Services. <br /> <br />Two or three people were present in the audience for flood updates, however, they did not wish <br />to enter the discussion at this time. Mr. Wieland said he understands there is a group of <br />people living south of County Road 16 who are submitting a letter regarding flood concerns. <br />
