18. <br /> <br />Commission Minutes--July 7, 1997 1652 <br /> <br />WHEREAS, there have been increasing occurrences of people parking vehicles and other camping <br />equipment at Brewer Lake campsites and leaving that equipment unattended for extended periods <br />of time; and <br /> <br />WHEREAS, County of Cass by and through the Cass County Park Board does not charge any fee <br />for the use of electricity or water at the campsites; and <br /> <br />WHEREAS, there are only a limited number of campsites which provide electricity and water <br />services; and <br /> <br />WHEREAS, unattended vehicles, campers or other camping equipment at the Cass County Park <br />Campground is not an effective and efficient use of limited services and becomes a hazard to other <br />campers and a target for criminal activity; <br /> <br />NOW, THEREFORE, be it ordained by the Board of Commissioners of the County of Cass that an <br />ordinance regulating the use of campsites at any Cass County park is hereby enacted as follows: <br /> <br />Campsites located at any Cass County Park under the direct operation and supervision of the <br />Cass County Park Board will be available to any persons and their camping equipment on <br />a first come first serve basis for a period of time not to exceed ten (10) consecutive days <br />during which time the campsite must be occupied by the person or persons who own, <br />possess, or otherwise have control of the camping equipment. Any campsite or camping <br />equipment which is left unoccupied or unattended for more than twenty-four (24) consecutive <br />hours, without written authorization from a representative of the Cass County Park Board will <br />be deemed to be abandoned and subject to towing and impound by the county at the expense <br />of the owner or user. <br /> <br />For purposes of this ordinance, camping equipment shall include, but not be limited to, <br />vehicles, recreational vehicles, campers, boats, trailers, or any other thing which is generally <br />recognized as recreational camping equipment. <br /> <br />CASS RURAL WATER USERS SYSTEM IMPROVEMENT PLAN <br />Mr. Keith Burley, Chairman of the Cass Rural Water Users Board, was present. He briefly reviewed <br />the Phase I Rural Water Project and United States Department of Agriculture (USDA) Rural <br />Development loan for funding of the project. <br /> <br />Mr. Wieland said the County Commission received information today from County Planning <br />Consultant Joel Quanbeck regarding this project. He said Mr. Quanbeck outlined two concerns: <br />1) land use jurisdiction in the extraterritorial area; and 2) that there are no conflicts with the proposed <br />project objectives. <br /> <br />Attorney Dan Twichell was present and said the USDA has a policy in which they will not fund <br />projects that are in conflict with other jurisdictions. Therefore, Mr. Twichell said the County <br />Commission needs to approve a motion stating there are no conflicts between the project and the <br />county's current plans. <br /> <br /> <br />
