12. <br /> <br />13. <br /> <br />14. <br /> <br />Commission Minutes--April 15, 1996 1459 <br /> <br />PLAT APPROVAL, Final Plat of Altenburg Acres First Subdivision <br />Commissioners received a letter dated April 4, 1996, from Joel Quanbeck, Cass County Planning <br />Office, concerning Final Plat of Altenburg Acres First Subdivision. Mr. Wieland, who is a member <br />of the Cass County Planning Commission, said they approved the plat with a condition regarding <br />the sewer system. Terry Ludlum, Sanitarian with Fargo Cass Public Health, was present and said <br />the developer was asked to design a specialized plan for the sewer system addressing the poor <br />soil percolation rates found on the proposed plat. MOTION, passed <br /> Mr. Wieland moved and Mr. Eckert seconded that the Cass County <br /> Board of Commissioners grant Final Plat approval to Altenburg Acres <br /> First Subdivision, SW% of Section 6 of Township 138N, Range 49W in <br /> Cass County, North Dakota, with the condition that the plat contain a <br /> note specifying the four lots needing specially designed on-site sewer <br /> systems due to poor soil percolation rates, and that the County does <br /> not guarantee trouble free service of such systems, and that a copy of <br /> the proposed specialized system be noted as a sample of such a <br /> system and be filed with the plat. On roll call vote, motion carried <br /> unanimously. <br /> <br />CONTRACT APPROVAL, North Dakota Department of Transportation <br />Mr. Eckert asked to discuss a proposed contract for school crossing improvements and <br />incidentals at Casselton. County Engineer Keith Berndt responded to his questions concerning <br />the engineer's estimate and the option which was ultimately selected. Moore Engineering <br />prepared the estimate of the project. The school district, the City of Casselton, the consultant and <br />Mr. Berndt made the design decision. Mr. Eckert also asked who would be responsible for paying <br />additional monies if the project is higher than estimated. Mr. Berndt said the local entities would <br />be responsible for any cost over-run. He said there is a written memorandum of understanding <br />among the agencies involved which the County Commission approved some months ago. <br /> MOTION, passed <br /> Mr. Eckert moved and Mr. Schneider seconded to approve the following <br /> contract submitted by respective department head and portfolio <br /> commissioner, subject to State's Attorney approval; and authorize <br /> chairman to sign: North Dakota Department of Transportation <br /> construction and maintenance agreement and right of way certificate <br /> for school crossing improvements and incidentals at Casselton. On <br /> roll call vote, motion carried unanimously. <br /> <br />SHEA SITE LISTING, Historic Re~ister <br />On April 1, 1996, Chairman Toussaint wrote a letter to the State Historical Society requesting <br />additional information on the nomination of Shea Site, 32CS101, Embden vicinity in Cass County, <br />to the National Register of Historic Places. Last Friday, April 12th, she received information on <br />the general location and description of the site, as well as Federal regulations describing the <br />notification procedures for National Register nominations and the waiver procedures. The Shea <br />Site nomination will be considered by the Review Board of the State Historical Society at their <br />meeting on April 26, 1996, in the Project Room, North Dakota Heritage Center, Bismarck. <br /> <br />A copy of the information and a memorandum were sent to State's Attorney John Goff asking for <br />his review and advice at today's Commission meeting.
