Minutes--January 2, 1996 1426 <br /> <br />BE IT FURTHER RESOLVED, That this resolution be inscribed upon the permanent records of <br />the proceedings of the Board of County Commissioners and a copy forwarded to her family. <br /> <br />Dated at Fargo, North Dakota, this 2nd day of January, 1996. <br /> <br />SHERIFF'S DEPARTMENT, Fuel supplier selected MOTION, passed <br /> Mrs. Toussaint moved and Mr. Wieland seconded to approve Stop-N- <br /> Go Stores, Inc. as the fuel supplier for Cass County Government in <br /> 1996 and 1997 at the rate of four cents per gallon over cost. On roll call <br /> vote, motion carried unanimously. <br /> <br />SHERIFF'S DEPARTMENT, Purchase order for copy machines MOTION, passed <br /> Mrs. Toussaint moved and Mr. Wieland seconded to authorize chairman <br /> to sign purchase order for two Lanier copy machines for the Sheriff's <br /> Department at a total cost of $12,691.80; and allow them to enter into <br /> a maintenance contract for said copiers. On roll call vote, motion <br /> carried unanimously. <br /> <br />WATER RESOURCE BOARDS, Committee to be appointed <br />Mrs. Toussaint said a request for board appointment to the Southeast Cass Water Resource <br />District was placed on the agenda for information purposes. Three of the four Cass County water <br />resource districts have board members who met the county's term limitation policy but continue <br />to serve until a successor is appointed. No applications were received for those appointments <br />until Mr. Ness completed an application for appointment to the Southeast Cass Water Resource <br />District. State law, however, prohibits county commissioners from serving on water boards. <br /> <br />State's Attorney John Goff was asked about drafting a home-rule ordinance to supersede state <br />law in this regard. Mr. Goff said the home rule charter does talk about home rule superseding <br />state laws with the exception of the ability of cities to govern themselves. He said there is no <br />clear answer regarding the water boards, especially since they are created in the statutes by the <br />legislature, not by county commissions. <br /> <br />Mr. Wieland proposed appointment of a committee to study issues broader than adopting an <br />ordinance to allow county commissioners to serve on water boards. Mr. Eckert agreed there is <br />merit in considering some changes concerning water boards and this should entail a certain <br />amount of study to address all of the issues. Mr. Ness was also in agreement with appointing a <br />study committee, and Chairman Toussaint will review the matter of setting up a committee and <br />criteria for that committee. <br /> <br />VOUCHERS, Approved <br />Concerning bills for cellular telephones used for county business, Mr. Ness said there is a lack <br />of consistency in programming telephones, resulting in higher billing. He suggested establishing <br />a policy to centralize where telephones are purchased and the programming. County Coordinator <br />Bonnie Johnson will work with Mike Steiner, Data Processing, on a proposed policy. <br /> MOTION, passed <br /> Mr. Wieland moved and Mr. Ness seconded to approve payment of <br /> Vouchers No. 82,973 through No. 84,019. On roll call vote, motion <br /> carried unanimously. <br /> <br /> <br />
