Comm. Minutes--June 19, 1995 1357

21.

9.2.

County State's Attorney John Goff. Also, Mr. Sovig said there will
be no direct cost to Cass County on this project. MOTION, passed
Mrs. Toussaint moved and Mr. Wieland seconded to approve
flood protection project #221-DF93-H as amended according
to request from Lake Agassiz Regional Council dated June
8, 1995. On roll call vote, motion carried unanimously.

FLOOD PROTECTION PROJECT 221-DF93-H, Lake A=assiz Re=ional Council
Mr. Sovig also asked for approval of a request for amendment on
flood protection project 150-DF93-H for a time extension to
complete the site demolition and clean-up because funding has not
yet been approved from the Public Assistance Program of the Federal
Emergency Management Agency. MOTION, passed
Mr. wieland moved and Mrs. Schneider seconded to approve
amendment extending the deadline for completion of
project 150-DF93-H. Discussion: A concern was raised by
Mr. Wieland about the county's liability on this property
and a suggestion was made to have the County Engineer
view the site and recommend a plan for demolition. The
Engineer can then poll commissioners about proceeding
with the site demolition and clean-up. On roll call
vote, motion carried unanimously.

BOKDERUD'S SUBDIVISION STREET IMPROVEMENT, D~¢ision delayed
Jeff Volk, Moore Engineering Company, reported that bids were
opened for the Borderud's Subdivision street improvement project,
and the homeowners are not in a position to accept the bids at this
time. He requested that the matter be placed on the July 17th
Commission meeting agenda.

Ross Holzmer, a resident of the subdivision, addressed the
Commission at this time to request that the county reconsider the
requirement that streets be at least 18' wide. If the street could
be 15' wide, (Mr. Holzmer said he talked to all of the homeowners
and they would be happy with 15'), then he would not have to move
his garage, which was built on the right-of-way prior to him
purchasing the property. In the interest of safety and looking to
the future, the Commission felt they could not deviate from the 18'
requirement. This is already a compromise because 20' was required
wherever practical.
MOTION, passed
Mr. Wieland moved and Mrs. Schneider seconded to table
the decision on the Borderud's Subdivision street
improvement project to the July 17, 1995, County
Commission meeting. Motion carried unanimously.
