Minutes--February 6, 1995 1297 <br /> <br />21. <br /> <br />2).. <br /> <br />23. <br /> <br />Last Friday, Mr. Berndt met with officials from the City of Kindred <br />and representatives of two neighborhood associations. These groups <br />re-affirmed their support of the project, which is planned for funding <br />at 80% Federal Transportation Enhancement funds and local costs being <br />shared between the City of Kindred and Cass County. <br /> <br />Concerning maintenance of the bikeway, Mr. Berndt will draft an <br />agreement and bring it to a future commission meeting. Mr. Eckert <br />suggested that funding for the county's 10% share of the project be <br />requested from the Cass County Park Board. <br /> <br />ROAD PAVING, Mapleton Bar <br />A request was received from Garland Hagemeister to appear before the <br />board of commissioners regarding asphalt paving work in front of a <br />tavern which he owns in Mapleton. Mr. Hagemeister was given an <br />opportunity to discuss his dissatisfaction with the project. He was <br />concerned about the height of the road prior to the blacktopping <br />because of run-off water standing in the low areas on his property. <br />He suggested lowering the road before putting on the asphalt. <br /> <br />The county engineer outlined the situation from his department's <br />standpoint in a memorandum to commissioners dated January 25, 1995. <br /> <br />Mr. Ness asked Mr. Hagemeister for an alternative solution. Mr. <br />Hagemeister said something should have been done before the first <br />layer of paving. <br /> <br />Mr. Eckert does not think it would be advisable to lower the road and <br />said there are several other residences which have low areas along <br />this project. Mr. Berndt said the highway is above the 100-year flood <br />plain, and he does not recommend lowering it. He will continue to <br />work with Mr. Hagemeister on the present situation. <br /> <br />Mrs. Toussaint said this should serve as a lesson on future projects <br />when the county is asked to get involved with private land. <br /> <br />RESOLUTION #1995-3, Senate Bill 2388 opposed MOTION, passed <br /> Mrs. Toussaint moved and Mr. Eckert seconded to adopt Resolution <br /> #1995-3, on file in the County Auditor's Office, opposing Senate <br /> Bill 2388, unless it is modified to clearly exempt land use, <br /> zoning and subdivision controls from the bill's influence and <br /> impact, according to memorandum from the county engineer dated <br /> February 3, 1995. On roll call vote, motion carried unanimously. <br /> <br />RESOLUTION #1995-4, Metropolitan Bikeway Plan approved MOTION, passed <br /> Mr. Eckert moved and Mrs. Toussaint seconded to adopt <br /> Resolution #1995-4, on file in the County Auditor's Office, <br /> approving 1995 Metropolitan Bikeway Plan with a comment <br /> that the Cass County Commission agrees with the overall <br /> plan but does not agree with inclusion of the strategy to <br /> encourage the State Legislature to repeal the section of <br /> North Dakota Century Code that does not allow bicyclists to <br /> ride on a roadway if the roadway has a bicycle path located <br /> <br /> <br />
