Minutes--March 21, 1994 1184 <br /> <br />12. <br /> <br />13. <br /> <br />RED RIVER VALLEY FAIRGROUNDS CAMPSITE, Ownership transferred to Cass <br />County Government <br />State's Attorney John Goff summarized the history of the campsite <br />located at the Red River Valley Fairgrounds. The County Commission <br />is being asked to take action transferring ownership of the campsite <br />from the Red River Valley Fair Association back to Cass County <br />Government until December 31, 2004, when ownership can once again <br />revert to the Red River Valley Fair Association. The fair association <br />will continue to operate the campsite consistent, with the terms of the <br />written agreement. <br /> <br />Contact by the North Dakota Parks and Recreation Department to the <br />State's Attorney about Cass County's authority to transfer the <br />campsite to the Fair Association, as executed April 6, 1992, prompted <br />this discussion because of federal funding initially provided to <br />construct the campgrounds. For the Board's consideration at this time, <br />Mr. Goff drafted an agreement whereby Cass County Government would be <br />placed in the same position as they were prior to April 6, 1992. <br /> <br />Jonathan Garaas, Attorney for the Red River Valley Fair Association, <br />said the April 6, 1992, agreement provided that, in the event of any <br />difficulties arising from the transfer, the Red River Valley Fair <br />Association would restore the property back to the original state. <br />They are prepared, at this time, to take whatever action is necessary <br />to accomplish that arrangement. <br /> <br />Mr. Eckert asked if the proposed agreement covers the campsite only, <br />and Hr. Garaas said the agreement covers the same legal description <br />for the campsite that was used when it was created. MOTION, passed <br /> Mr. Ness moved and Mrs. Toussaint seconded to authorize the <br /> Chairman and County Auditor to sign an agreement with the <br /> Red River Valley Fair Association for transfer of campsite <br /> property back to Cass County Government, with the fair <br /> association continuing to maintain and operate the <br /> campsite. On roll call vote, motion carried unanimously. <br /> Mr. Ness asked how the State Parks and Recreation <br /> Department will be notified of today's action. Mr. Goff <br /> will contact them after the documents are fully executed. <br /> <br />SHERIFF DEPARTMENT, Military ambulance retained <br />Concerning the military ambulance parked in the Juvenile Justice <br />Center parking lot, Sheriff Don Rudnick said the City of Fargo may be <br />interested in acquiring the vehicle for a tactical team. However, Pat <br />Conner, leader of the sheriff's reserve unit, said his group has <br />discussed fund raising efforts for the purpose of painting the vehicle <br />and getting it on the road for use at the fairgrounds this summer and <br />for emergency water rescue operations. <br /> <br />Mr. Ness said he understood from the last meeting there is a suburban <br />that could be designated for use by the reserve unit rather than using <br />the ambulance, which is very old and awkward. He asked Mr. Conner if <br />the suburban would serve their needs if fixed up, and Mr. Conner said <br />he wasn't aware of that being an option. He said it would suit their <br />needs, but they prefer the ambulance because it has a heavier frame. <br /> <br /> <br />
