I requested the City <br />Attorney of Horace, North Dakota, provide input into the preparation of the City of Horace's <br />response to your request. <br /> <br />The City of Horace looks forward to any j oint meetings involving our City and the Cass <br />County Commission to discuss matters of common interest or concern. Both governmental <br />entities provide essential services to the inhabitants of the territory under their respective <br />jurisdictions. There necessarily exists overlap of governmental services, and a need for <br />cooperative effort, because Cass County, North Dakota, includes every municipal corporation, <br />large or small, within its far larger geographical area. <br /> <br />North Dakota has declared its legislative intent in N.D.C.C. S 24-01-01 "determin(ing) <br />and declar(ing) that an adequate and integrated system of roads and streets is essential to the <br />general welfare of the state of North Dakota." In discussing this significant governmental <br />responsibility, the North Dakota Legislative Assembly recognized the role of the county <br />government: <br /> <br />While it is necessary to fix responsibilities for the construction, <br />maintenance, and operation of the several systems of highways, it is intended <br />that the state of North Dakota shall have an integrated system of all roads and <br />streets to provide safe and efficient highway transportation throughout the state. <br />To this end, it is the intent ofthe legislative assembly to give broad authority and <br />definite responsibility to the director of the department (of transportation) and <br />to the boards of county commissioners so that working together, free from <br /> <br />1 <br />
