Minutes--August 17, 1992 905 <br /> <br />17. <br /> <br />NOTE: The Cass County Commission cannot be expected to make <br />knowledgeable decisions nor to assume responsibility for those decisions <br />other than as set forth in a contract for service since this commission does <br />not have full involvement in the entire process of loan application reviews, <br />the appointment of board members, the hiring of staff, and establishment of <br />salaries, personnel policies and procedures. <br /> <br />F) <br /> <br />Cass County taxpayer dollars, not exceeding the revenue <br />generated from 2.7 mills for budget year 1993, will be released <br />to the described "no risk loan pool" to match any cash donation <br />of a dollar to the same "no risk loan pool" so long as the <br />dollar was not originally levied by Cass County Government. No <br />in-kind or non-cash donations of any manner will be matched with <br />county taxpayer money or services. <br /> <br />G) <br /> <br />As requested by FCCEDC, county funds donated to this loan pool, <br />if made, will not go beyond Cass County budgeting year 1996. <br /> <br />H) <br /> <br />The Cass County Treasurer will be custodian of this "no risk <br />loan pool" until FCCEDC obtains proper federal IRS tax status <br />which allows donations to the pool to be tax-exempt. <br /> <br />i) <br /> <br />FCCEDC is required to obtain appropriate IRS tax designation on <br />or before July 1, 1993. At that time, all non-county source <br />funds of any kind which may be held by Cass County Government on <br />behalf of FCCEDC are to be promptly transferred to FCCEDC under <br />the direction of the County Auditor. <br /> <br />J) <br /> <br />Cass County Government expresses its support for the efforts to <br />increase the economic base of this community and acknowledges <br />that FCCEDC is an independent entity organized under its own <br />bylaws, that it appoints its own board of directors, it hires <br />its own staff for whom it also set qualifications and <br />compensation and is responsible for its own personnel policies <br />and procedures. FCCEDC is not a job development authority <br />organized under state statute by Cass County Government; Cass <br />County State's Attorney is not an attorney for FCCEDC and FCCEDC <br />does not have authority to use the sales tax exemption number <br />granted by the State of North Dakota for use by Cass County <br />Government. <br /> <br />Dated at Fargo, North Dakota, this 17th day of August, 1992. <br /> <br />CASSELTON SEWER AND WATER EXTENSION, Letter of support MOTION, passed <br /> Mrs. Toussaint moved and Mr. Eckert seconded to send a <br /> letter to the City of Casselton with a statement that their <br /> proposed water and sewer extension is not in conflict with <br /> any county plans. On roll call vote, motion carried <br /> unanimously. <br /> <br /> <br />
