Minutes--July 20, 1992 887 <br /> <br />19. <br /> <br />COURTHOUSE PARKING/TRAFFIC/BUILDING, Road Department outbuilding at <br />Casselton value established, Head Start lease terms, adoption of "Cass <br />County Government Space Recommendations" <br />Mr. Shannon prepared a document titled, "CASS COUNTY GOVERNMENT SPACE <br />RECOMMENDATIONS" and he presented it earlier today at a meeting of the <br />Space and Planning Committee. That committee recommended that the <br />document be forwarded to the Cass County Board of Commissioners for <br />approval. Mr. Shannon outlined the ten points in the seven-page <br />document. <br /> <br />Under item #9, sale and lease of miscellaneous property, Mr. Shannon <br />recommended sale of an unused road department outbuilding in Casselton <br />to the City of Casselton for $950, subject to concurrence by the new <br />department head of the Cass County Road Department. Mr. Shannon said <br />a decision must be made by the Cass County Road Department and <br />Disaster Emergency Services about whether or not communications <br />equipment will remain on location as a condition of sale. If the <br />decision is made at the time of sale to retain the equipment, Cass <br />County Government shall reserve the right to replace, maintain or <br />improve said property or to abandon or remove any such property in the <br />future at its sole discretion and without any access charges or fees <br />or costs in cash or in kind to be paid by Cass County taxpayers. <br /> <br />Mr. Shannon asked if there is anyone in the audience who may be <br />interested in purchasing the road department outbuilding, but no one <br />was present. <br /> MOTION, passed <br /> Mr. Shannon moved and Mr. Eckert seconded to pass a <br /> resolution whereby the Cass County Commission establishes <br /> the property in question in the City of Casselton as having <br /> financial value of less than $1,000. Discussion: Mr. <br /> Shannon said there is potentially large liability to the <br /> county regarding removal of a fuel tank which exists on the <br /> property, and that is the primary reason for establishing <br /> the value at this amount. At the call for the question and <br /> on roll call vote, motion carried unanimously. <br /> <br />Also under recommendation #9, Mr. Shannon said a proposed lease with <br />SouthEastern North Dakota Community Action Agency (SENDCAA) for the <br />Head Start program should be changed from 99 years to two years, which <br />is the maximum length of time the board of commissioners can enter <br />into a lease, according to the State's Attorney. Mr. Shannon <br />suggested a letter to James Kappel, Executive Director of SENDCAA, <br />asking him to lobby for a change in North Dakota Century Code 48-08-07 <br />to allow for a longer term lease. <br /> <br />Under recommendation #10, Mr. Shannon asked to include a date when the <br />County Auditor can evaluate the status of records storage and make <br />recommendations for disposal or microfilming. The Auditor said he <br />will make a report to the Commission the first meeting this December. <br /> MOTION, passed <br /> Mr. Shannon moved and Mr. Risher seconded to adopt the <br /> "CASS COUNTY GOVERNMENT SPACE RECOMMENDATIONS" as outlined <br /> on pages 1-7 (copy attached).
