22. <br /> <br />Comm. Minutes--January 21, 1992 814 <br /> <br />He suggested the Cass County Park Board hold a meeting and take <br />official action to terminate the lease agreement dated April 18, 1979, <br />creating the Cass County Campsite. Also, he said the County Commission <br />must approve and adopt a resolution estimating the value of the real <br />property to be transferred to be of a value less than $1,000. <br /> <br />He said it is his opinion and his recommendation to the Board that the <br />real property which is the subject of this discussion is actually a <br />liability to the county rather than an asset. Cass County has <br />ownership of the real property in name only with no right to use or <br />control the property. He said the only real interest Cass County has <br />in the fairgrounds property is potential liability for personal injury <br />or property damage. Therefore, he said the Red River Valley Fair- <br />grounds and Bonanzaville have a negative value to Cass County. <br /> MOTION, passed <br /> Mr. Shannon moved and Mr. Risher seconded to adopt the <br /> following resolution prepared by the State's Attorney: <br /> "Pursuant to Section 11-27-01 of the North Dakota Century <br /> Code, the Cass County Board of Commissioners estimates the <br /> value to Cass County of ownership of the Red River Valley <br /> Fairgrounds and Bonanzaville real properties is less than <br /> $1,000.00 because of the Red River Valley Fair <br /> Association's perpetual right to use the real property as <br /> set forth in a warranty deed dated April 12, 1979, and the <br /> potential civil liability of Cass County for ownership in <br /> name only, and therefore, the property may be sold at a <br /> private sale." <br /> AMENDED MOTION, passed <br /> Mr. Shannon moved and Mr. Risher seconded to amend the <br /> motion whereby "...the property may be sold at a private <br /> sale." As drafted, the last sentence read, "... shall be <br /> sold at a private sale." Motion carried on the amendment. <br /> Discussion: Mr. Eckert thinks the value of the tract of <br /> land, excluding the Road Department, is worth more than <br /> $1,000 and said he would purchase the property. <br /> Mr. Shannon said the property is not Cass County's value. <br /> The value, he said, was given away. At the call for the <br /> question and on roll call vote, the motion carried with <br /> four members voting "Aye" and Mr. Eckert opposing. <br /> <br />COMMITTEE REPORTS <br />Mr. Risher said the State of North Dakota has scheduled a meeting <br />Friday at the Courthouse on solid waste issues. <br /> <br />Mike Steiner said the Attorney General's Office asked for permission <br />to install their own telephone lines for offices they occupy in the <br />basement of the south wing, rather than paying the county's per-line <br />charge. Mrs. Toussaint said it may not be too far into the future <br />when Social Services will need to expand their offices into this area. <br />Mr. Shannon suggested telling the Attorney General's office that they <br />may use their own lines but will still be charged $40 per line by Cass <br />County since they will be using the County's hardware. <br /> <br />Mr. Shannon suggested that the Chairman schedule a meeting of the <br />space and planning committee in the near future. <br /> <br /> <br />
