Motion carried on <br />the amendment. On roll call vote, the motion carried <br />unanimously on the main motion. <br /> <br />PERMIT FOR SALE OF ALCOHOLIC BEVERAGES ON SUNDAY, Chaffee Bar and Cafe <br />A written request was received from Richard. and LaVonne Schroeder for <br />a special Sunday opening permit for the Chaffee Bar and Cafe beginning <br />January 26, 1992. <br /> <br />From information provided by Schroeder's, John Golf said it appears <br />that more than 50% of their gross receipts is derived from the Chaffee <br />Cafe, thus qualifying the business under the statutory definition of <br />"restaurant" according to North Dakota Century Code 5-02-05.1. <br /> <br />Richard and Donald Schroeder were present, and Richard Schroeder said <br />they plan to have the bar open about one Sunday per month but don't <br />want to be limited to that. Mr. Shannon suggested using the same fee <br />structure as for The Windbreak, that is, charging an application fee <br />of $25 plus $10 per Sunday for the rest of the year. Mr. Schroeder <br />shall verify which Sundays they are not open, and he can get a rebate <br />of $10 for each of those Sundays. The rebate can be given at the end <br />of 1992, or sooner if Mr. Schroeder knows he won't be open again for <br />the rest of the Sundays within the year. <br /> <br />Lt. Arland Rasmussen, Sheriff's Department, said their records <br />indicate no illegal incidents on the part of the Chaffee Bar in 1991. <br /> MOTION, passed <br /> Mr. Shannon moved and Mrs. Toussaint seconded to approve a <br /> special Sunday opening permit for the Chaffee Bar and Cafe <br /> beginning January 26 and through the balance of 1992 for an <br /> application fee of $25 plus $10 per Sunday; noting that <br /> this is subject to a rebate for any Sundays they decide not <br /> to be open; to be paid either at the end of the year or at <br /> any time in which they decide not to be open any more <br /> Sundays in 1992. On roll call vote, motion carried <br /> unanimously. <br /> <br />RESOLUTION OF CONGRATULATIONS, Oscar and Vi Sondrall MOTION, passed <br /> Mrs. Toussaint moved and Mr. Shannon seconded to adopt a <br /> resolution of congratulations to Oscar and Vi Sondrall <br /> celebrating their 65th wedding anniversary on January 26, <br /> 1992. Motion carried. <br /> <br />RED RIVER VALLEY FAIRGROUNDS, Value of real property established <br />Commissioners received a letter from State's Attorney John Golf, dated <br />January 16, 1992, regarding transfer of all the property containing <br />the Red River Valley Fairgrounds and Bonanzaville, excluding the Cass <br />County Road Department, to the Red River Valley Fair Association. <br />Mr. Golf explained his letter, saying there are two additional steps <br />which must be taken prior to completion of the transfer. <br /> <br /> <br />
