Minutes--January 21, 1992 812 <br /> <br />ROAD DEPARTMENT, Purchase of portable scale <br />Steve Grindberg requested permission to purchase a portable scale to <br />be installed on front-end loaders, which will give total weight while <br />a truck is being loaded and a total weight at the end of the day. He <br />thinks it will resolve the problem of overweight fines that the Road <br />Department has been getting. <br /> <br />Mr. Shannon questioned the need for Board approval since there is <br />money in the Road Department budget to purchase a scale, but <br />Mr. Wieland said this item wasn't specifically requested at budget <br />time. <br /> MOTION, passed <br /> Mr. Eckert moved and Mr. Risher seconded that the Road <br /> Department be authorized to purchase a Tuffer III scale at <br /> a cost of $5,035 from their 1992 equipment budget. On roll <br /> call vote, motion carried unanimously. <br /> <br />ROAD AUDIT, January report to be presented mid-February <br />Steve Grindberg said he wasn't able to complete the request to give <br />an audit report at this meeting, and he requested additional time to <br />prepare it. He said he will give the January report at the second <br />meeting in February, and will continue monthly in that pattern. <br /> <br />PERMIT FOR SALE OF ALCOHOLIC BEVERAGES ON SUNDAY, Windbreak Saloon <br />A written request was received from The Windbreak Saloon manager for <br />a special Sunday opening permit for 1992 beginning February 2nd. <br /> <br />State's Attorney John Goff said the County Commission has authority <br />to grant a special Sunday permit pursuant to North Dakota Century Code <br />5-02-05.1, providing the applicant meets the definition of the term <br />"restaurant" as contained in the statute. One of the qualifying <br />factors is that a restaurant derives 50% or more of its annual gross <br />receipts from the sale of prepared meals and non-alcoholic beverages. <br /> <br />The Windbreak provided sales and use tax information for a period of <br />10 months showing sales for alcoholic beverages are less than the <br />total of all other sales, assuming that "all other sales" means <br />prepared meals and non-alcoholic beverages. Dan Heiberg, Manager of <br />the Windbreak Restaurant and Saloon, said "all other sales" as <br />reported on the tax returns are for prepared meals. He said <br />Windbreak, Inc. includes the restaurant and bar. Another corporation <br />owns the truck stop. Under these conditions, Mr. Golf said The <br />Windbreak Restaurant and Saloon would meet the definition of the <br />statute. <br /> <br />In a letter -to the Commission from Lt. Arland Rasmussen, Sheriff's <br />Department, apparently no liquor law violations were committed by the <br />management of the Windbreak Saloon since those reported January 13 and <br />20, 1991. <br /> MOTION, passed <br /> Mr. Risher moved and Mr. Shannon seconded to approve a <br /> special Sunday opening permit for The Windbreak Saloon <br /> beginning February 2nd, 1992, for an application fee of $25 <br /> plus $10 for every Sunday of opening; said permit to expire <br /> February 2, 1993. <br /> AMENDED MOTION, passed <br /> <br /> <br />
