<br />Comm. Minutes--July 1, 1991 703 <br /> <br />17. RIGHT OF WAY CONDEMNATION, County Road 22 ~radin~ project <br />County Engineer Don Richards requested authorization to proceed with <br />condemnation of right of way for highway construcEion purposes. In <br />a memo to the Commission, he said Mrs. Helen Wentz of Lake Havasu <br />Ci ty, Arizona, has not agreed to accept the amount established by <br />appraisal and negotiations as fair market value for approximately <br />0.633 acres needed for permanent right of way for Project CR 8827- <br />2204/05 (County Road 22 grading project). <br />MOTION, passed <br />Mr. Eckert moved and Mr. Wieland seconded to authorize the <br />chairman to sign a resolution for declaration of public <br />necessity requiring the taking of a specified tract of land <br />for permanent right-of-way for highway construction <br />purposes, in accordance with Chapter 24-05, Section 09 to <br />14 and Section 16, Article 1 of the North Dakota <br />Constitution, said property belonging to Philip and Helen <br />Wentz and described as the north 32' of the south 65' of <br />the SE 1/4 of the SW 1/4 of Section 34, Township 141 North, <br />Range 49 West of the 5th Principal Meridian, excepting the <br />east 417.42 feet and also excepting all that portion <br />previously set aside for right of way purposes; and approve <br />appointment of a special board consisting of the County <br />Auditor, the County Treasurer and the Register of Deeds of <br />Cass County to fix the damages for such taking. On roll <br />call vote, motion carried unanimously. <br /> <br />18. COMMISSION, Policy handbook to be prepared <br />Commissioners have, in the past, talked about developing a policy <br />handbook so that Commission policies are combined in one place. This <br />effort may also show areas where the Commission needs to make a policy <br />position. Mrs. Toussaint is willing to work on this project. <br />MOTION, passed <br />Mrs. Toussaint moved and Mr. Eckert seconded to appoint <br />Commissioner Toussaint to work with the County Coordinator, <br />Commission Secretary, other Commissioners, department heads <br />and staff as may be necessary to develop a proposed policy <br />manual handbook for use by the Cass County Commission. On <br />roll call vote, motion carried unanimously. <br /> <br />19. VOUCHERS, Review and approval <br />Mr. Wieland reviewed the list of vouchers this month. He commented <br />on the number of newspaper subscriptions purchased by the county and <br />suggested that Commissioners see if all subscriptions are necessary <br />when they visit with their portfolio departments at budget time. <br /> <br />Mr. Wieland contacted the County Road Department for an explanation <br />of a fine from Clay County Court for over $600 for an overloaded <br />gravel truck. He was told the pit where gravel is purchased for <br />county roads does not have a scale so it is difficult to estimate when <br />a truck is overloaded. This is not the first overload fine the County <br />has paid. Mr. Eckert was asked to check on the cost of leasing a <br />portable scale and report back to the Commission at the next meeting. <br />MOTION, passed <br />Mr. Wieland moved and Mr. Risher seconded to approve <br />Vouchers No. 26,602 through No. 27,500. On roll call vote, <br />motion carried unanimously. <br />
