<br />Comm. Minutes--June 3, 1991 683 <br /> <br />17. FAIR LABOR STANDARDS ACT (FLSA), States Attorney to hire consultant <br />On April 15, 1991, the Commission adopted a motion, at the request of <br />the Sheriff's Department, whereby all first line supervisors and all <br />other sworn personnel below them were temporarily classified as non- <br />exempt employees, this being subject to completion of a review of the <br />FLSA. At that time, States Attorney John Goff recommended a review <br />of the FLSA as it affects all county employees, not only the Sheriff's <br />Department, and the Commission asked him to report back to them. <br /> <br />Mr. Goff said he spoke with the U.S. Department of Labor but was told <br />they would not have time to address problems Cass County might be <br />having or to make suggestions for improvements. He was then referred <br />to the branch office of that department, but was told that office will <br />be closing at the end of this month. <br /> <br />In the interest of time, Mr. Goff suggested hiring someone on a <br />consulting basis to study the FLSA as it applies to county employees. <br />Mr. Risher said the Commission adopted a motion January 21, 1991, <br />authorizing the States Attorney to use $7,500 in roll-up money from <br />the salaries line item in his budget to contract for outside legal <br />services. Mr. Goff said that motion specified that the money be used <br />for prosecutorial responsibilities, but it was the consensus of the <br />Commission today that he use some of this money for review of the Fair <br />Labor Standards Act. <br />MOTION, passed <br />Mr. Risher moved and Mrs. Toussaint seconded to clarify the <br />source of funds for the States Attorney to use $7,500 in <br />roll-up funds from his budget to proceed with the FLSA <br />review. On roll call vote, motion carried unanimously. <br />When the Sheriff's Department attended the April 15th <br />meeting, Mr. Shannon said it was reported that overtime <br />would amount to about $100 per month for three employees <br />who were changed from exempt to non-exempt status under the <br />FLSA, but he said their overtime is much higher than that. <br /> <br />18. VOUCHERS, Approved <br />After reviewing several vouchers for this month, Mr. Shannon <br />questioned a billing from Cass County Electric Cooperative for two <br />monthly payments for highway 10 lighting near West Fargo. He <br />recommending holding payment on the highway 10 lighting and schedule <br />it on the next meeting agenda for a report from Commissioner Eckert <br />and the States Attorney. <br />MOTION, passed <br />Mr. Eckert moved and Mr. Risher seconded to approve <br />Vouchers No. 25,664 through No. 26,601, excluding the two <br />billings for highway 10 lighting on Voucher No. 26,301. <br />On roll call vote, motion carried unanimously. <br /> <br />19. SHERIFF DEPARTMENT, Out of state travel approved <br />MOTION, passed <br />Mr. Wieland moved and Mr. Eckert seconded to approve out of <br />state travel for DARE Officer Patti Wasmuth to attend a <br />training session in Anoka County, Minnesota on June 16-18, <br />1991. On roll call vote, motion carried unanimously. <br />
