Minutes--June 3, 1991 680 <br /> <br />The cornmi t tee also recommended that the City of Fargo contracts <br />continue to include the addi tional $ 7.00 per hour for pre-trial <br />detainees arrested by the City of Fargo for alleged violations of <br />driving or being in actual physical control of a vehicle under the <br />influence of intoxicating liquor representing reasonable cost and <br />expenses incurred by the county to comply with the order of the <br />Honorable Thomas A. Davies, Judge of Municipal Court, dated December <br />10, 1990. <br /> <br />Mr. Risher asked what the current rates are, and Mrs. Johnson said the <br />current rates plus the booking fee, according to the sheriff, are <br />$12.50 per day for Fargo, West Fargo and Cass County prisoners; $30.00 <br />per day for out of county prisoners; and $45.00 per day for federal <br />prisoners. The current rate for the Juvenile Justice Center is $30.00 <br />per day plus the booking fee. This rate probably had not changed <br />since the Juvenile Justice Center was built, Sheriff Rudnick told the <br />committee. <br /> <br />Mr. Goff said he understands the proposed fee increase will cover <br />actual costs of holding people in these facilities. Cass County has <br />basically been subsidizing the housing of juveniles in the detention <br />center for some time. <br /> <br />Mr. Eckert didn't think the City of Fargo should pay the same rate as <br />other people using the facility who do not pay taxes in Cass County, <br />but Mrs. Toussaint said the actual cost of holding prisoners in the <br />jail is the same for everyone. Mr. Wieland favored the rate increases <br />because he favors user fees as a way to reduce the burden on real <br />estate taxes. <br /> <br />Hr. Shannon said former States Attorney Robert Hoy told the Commission <br />that the county is not obligated by state law to provide a jail. <br />MOTION, passed <br />Mr. Wieland moved and Mrs. Toussaint seconded to adopt the <br />new rate schedule for the jail and juvenile detention <br />center as follows: <br /> <br />A. A daily rate for prisoners booked into the Cass County <br />Jail shall be set at $46.00 per day. In addition, the <br />$10.00 booking fee presently in place shall increase <br />to $15.00. <br /> <br />B. A rate of $102.00 per day shall be established for <br />juveniles held in the Cass County Juvenile Detention <br />Center. In addition, the $10.00 booking fee shall increase <br />to $15.00. <br /> <br />Further, these rates should be reviewed in the spring of <br />each year so that users can be notified prior to their <br />budget cycle, with changes becoming effective on the first <br />day of the year following such notice. On roll call vote, <br />the motion carried with four members voting "Aye", Mr. <br />Eckert opposing. <br />
