Comm. Minutes--December 19, 1989 397 <br /> <br />MOTION, passed <br />Mr. Wieland moved and Mr. Sondrall seconded to adopt the <br />recommendation of the Benefits Committee in regard to the <br />health insurance contract renewal for 1990, which is to <br />amend the COST MANAGEMENT PROGRAM to eliminate the <br />"Mandatory Second Surgical Opinion for Specific Elective <br />Procedures"; and to allow the Chairman to sign Attachment <br />A of the Blue Cross-Blue Shield contract for providing <br />administrative services and re-insurance for the Cass <br />County Group Health Plan. On roll call vote, the motion <br />carried unanimously. <br /> <br />14. LEASE AGREEMENT, Office space at Juvenile Center MOTION, passed <br /> Mr. Wieland moved and Mr. Shannon seconded to renew the <br /> lease agreement with the State Director of Institutions for <br /> office space at the Juvenile Center at the same rate as for <br /> 1989, with the inclusion of a 90-day termination clause. <br />., On roll call vote, the motion carried unanimously. <br /> <br />15. LEASE EXPIRES ON PASTURE LAND, Sale of land approved <br /> MOTION, passed <br /> Instead of, leasing County-owned pasture land in the <br /> southwest quarter of Section Six, Rochester Township, Mr. <br /> Wieland moved and Mr. Sondrall seconded to advertise the <br /> property for sale with bid opening about March 1, 1990. <br /> Mr. Wieland suggested that the States Attorney be asked to <br /> prepare the legal documents. Motion carried. <br /> <br />16. RESOLUTION ~1989-22, Victim/Witness Advocates <br />Peg Winters and Shona Dockter proposed a resolution implementing <br />House Bill 1061, which would help counties and cities pay for <br />victim/witness advocate programs. The money that is generated will <br />go to the County General Fund but will pay for services necessary to <br />victims of crime. It is questionable whether the fees generated will <br />be enough to cover the cost of administration, but Ms. Winters felt <br />this is the only way to find out. She said the States Attorney has <br />discussed it with County Judge Frank Racek, and the judges would <br />attempt to implement it. MOTION, passed <br /> Mr. Shannon moved and Mr. Sondrall seconded to adopt <br /> Resolution ~1989-22 as follows: <br /> BE IT RESOLVED BY THE COMMISSION OF CASS COUNTY, NORTH <br /> DAKOTA, That the County Judges are hereby authorized and <br /> requested to assess a fee, not to exceed twenty-five <br /> dollars, as a part of each sentence imposed on a defendant <br /> who pleads guilty to or is convicted of a misdemeanor <br /> offense, unless the defendant is indigent and unable to pay <br /> the fee. <br /> Such fee would be in addition to any fine, penalty, costs <br /> or administrative fee prescribed by law. All fees paid to <br /> the County must be deposited monthly in the County treasury <br /> for future allocation by the County Commission to support <br /> the Cass County Victim/Witness Assistance Program sponsored <br /> by the States Attorney's Office whose primary function is <br /> to provide direct services to victims of and witnesses to <br /> crime. <br /> <br /> <br />
