Hinutes--Nov. 7, 1989 374 <br /> <br />government is also a contributor to the small business incubator <br />project and is requesting an addendum stating that federal <br />regulations will be used if it becomes necessary to dispose of the <br />property if LARC defaults. MOTION, passed <br /> Mr. Shannon moved and Hr. Sondra]l seconded that the <br /> Chairman be authorized to sign the addendum and any <br /> supporting documentation, subject to the States Attorney's <br /> review before final adoption. States Attorney Robert Hoy <br /> said he reviewed the code of federal regulations which <br /> essentially provides for a method of distributing the <br /> assets of the project if it defaults. Mr. Rustad said the <br /> six counties have already passed the resolution to support <br /> the project if LARC were to default. If the property were <br /> disposed of, the railroad lease would be converted to <br /> whoever purchases it. For the amount of the annual lease <br /> payment, $14,400, he could not foresee that LARC would <br /> default on a project such as this. Motion carried. <br /> <br />7. LARC, Economic development <br />Irv Rustad requested additional time on the agenda to report that a <br />consulting firm from Pennsylvania was hired for the small business <br />incubator project. He proposed that Cass County assist with <br />developing a pool of funds to help new businesses get started. He <br />offered to begin the process of bringing people together to discuss <br />what funds are needed. Mr. Shannon informed Mr. Rustad that the <br />County has a job development levy and it is hoped that the <br />organizations involved will start working together. Mr. Rustad said <br />he was not aware of the job development levy. <br /> <br />8. U.S. WEST COMMUNICATIONS, Utility Permit across C16 MOTION, passed <br /> Upon recommendation of the Road Department, Hr. Sondrall <br /> moved and Mrs. Toussaint seconded to grant a utility permit <br /> across County Road 16 between Section 1, Davenport Township <br /> and Section 36, Addison Township. Motion carried. <br /> <br />9. SHERIFF, Traffic safety grant <br />Sheriff Don Rudnick appeared regarding a traffic safety contract <br />between the North Dakota State Highway Department and Cass County in <br />the amount of $20,000 that would be awarded to Cass County to enforce <br />the 55 miles per hour speed limit in an effort to reduce accidents in <br />the County. He said the grant would amount to $15,000 the second <br />year and $10,000 the third year the program is in operation. <br /> <br />Sheriff Rudnick recommended applying the grant money toward the <br />salary of one of two staff positions which he requested at budget <br />time. Mr. Wieland said two positions were approved subject to a <br />staffing analysis showing the need for it, and he said the staffing <br />analysis should be completed before adding staff. <br /> <br />The staffing analysis is another reason why the Sheriff is appearing <br />today. He requested that the staffing analysis be started before the <br />first of January. <br /> <br />Mr. Shannon said money for the staffing analysis was approved in the <br />1990 budget. <br /> <br /> <br />
